Who's Fault Is It?
OKay so last night we're in a convoy. It goes BMW 325i, Jaguar whatever, Nissan Altima, Toyota Camry, then my civic. The first 3 cars are going in a convoy to some girls house.
There is a light, the BMW passes through the yellow but makes an abrupt stop almost in the middle of the road. The Jaguar hits the back of the BMW. The BMW has a few paint chips, but the Jaguar has a broken bumper, bent hood, cracked windshield, and both airbags deployed.
Who is at fault? I know it's usually the one who hits in the back's fault, but does it matter that there was an abrupt stop in the middle of the road?

In going with that, I'd say the Jag. If the BMW took the yellow, chances are the Jag was in the red and therefore at fault. Even though the BMW stopped abruptly, had the Jag stopped at the light instead of trying to beat it, this would not have happened.
Either way the Jag will be at fault. He was following too close to be safe. At least thats what the police and insurance will say. The BMW was obeying the law by stopping at a yellow light. The abrupt stop will not matter because its the responsibility of the Jag to control his own vehicle and keep it at a safe distance.

in an accident like that, isnt it almost always at fault of the person in the back..? thats what i was told..
