Overtime Pay in Virginia

Would anyone happen to know the law pertaining to overtime pay in Virginia? Getting screwed here and need some help.

well explain your situation and job. Some places are exempt from paying there employees overtime, while others have to but dont. I was in a job like that, I was not getting paid overtime, I would just get paid regular pay in cash for overtime. I then went to the hour and wage division and complained and they did an investigation on my work and they had to pay everyone overtime. I got like $500 out of it. The boss was pissed to. But I could care less.

Well basically what's going on is that I'm working at a privately owned RadioShack, I'm being paid by the hour. Even though I am the store manager I believe that since I am being paid hourly I am still entitled to overtime pay. Oh and I have had MAYBE 4 lunch breaks in the past six months. THAT I know for a fact is illegal but unfortunately I have no way to prove it. Now, from what I understand, if you are being paid hourly anything over 40 hours is overtime but if you're payed salary you can work up to 50 hours before overtime kicks in. Somebody PLEASE correct me if I am wrong.

well if you are a manager I think overtime doesnt count, but I am stumped because you get hourly pay. I would contact the hour and wage division about that.

even though the store you work in is privately owned, there must be a corporate human resources division for radio shack. contact them, explain the situation, and hopefully you can resolve it with them.

Somehow I doubt that radioshack would give a ****. They don't give a god-damn about their dealer stores. They already know that I'm the only one working here. There is one problem though, The owner doesn't track my time on the computer, which I could fix but he probably wouldn't like that too much. So, therefore I have no proof.

If you have a degree or are in a management position you are not entitled to O.T. (you get salary) It happened at my job in NJ (Civil Engineering) and they had to give everyone back payfor like 5 years. Call the labor dept. in your area and asked them who to talk to.

We got busted when a disgruntled employee was fire and made a call to the labor dept.

I'm pretty sure that labor laws are very similar for most states when it comes to employees.

I'm not a lawyer but that’s what happened at my job and that was the reason for the back pay.

There's a difference there, yes, I am a store manager, but, i'm being paid hourly not salary.

I understand, everyone with a degree or in management was getting paid hourly also and they did not get any back pay.
