PLEASE HELP!!! Im IN DEEP ****!!!

Sup fellas,


I was just sitting here with nothing to do so I thought I would ask this question due to the fact that Im dealing with the BS right now

I Live In NY and we have a point system for our licence. I recieved 2 speeding tickets in a 2 year period and now they are taking away my licence.

We cannot get over 11 points on out licence. So here is the deal:

1st ticket: 8 Points - Pleeded Guilty
2nd Ticket: 6 Points - Pleeded Not Guilty Than Pleeded Guilty (Ill explain)
Grand Total: 14 Points


Ok so here is the question:

When I got the 2nd ticket I pleeded not guilty because I new i was going to lose my licence. After I did that I took a 5 Hour course which takes of 4 points of of your licence. This should leave me with a grand total of 10 Points which means I am 1 under the limit. Now I moved so I missed my court date so I ended up pleeding guilty anyway due to the fact I thought I was ok because of the 5 Hour Course. A few weeks later I get a letter from the NY DMV stating that I am losing my licence for a minimum of 6 months!

I know that when you pleed guilty or are found guilty they go from the date of the ticket and that might cancel out my 5 hour course but shoudnt it do something? I am now going inot the DMV and asking if I it counted and took points off of my licence. This could be a loop hole but I am not sure. How can they not take points off of your licence if you were not found guilty yet.

So Ill go over it one last time:

1. Got ticket which would put me over 11 points (14 points)
2. Pleeded not guilty and Took 5 hour course
3. This should have put me at 10 points (saftey zone)
4. I Pleeded guilty due to some complications
5. Now I have my licence being taken from me even though i took the course
6. Even though I got my ticket before the 5 hour course it should count due to the fact that i stalled being guilty and than took a course to take off 4 points.

You guys think this is a loop-hole and maybe if I go into the DMV with proof of the 5-Hour course I can maybe get out of this or get a shorter suspension?

get a lawyer. trust me, when i got pulled over for 103 mph, i was able to get a regular ticket (19+ over the limit)

i don't know how 19+ is a "regular" ticket!

but anyway, have they in fact taken it away yet? or was it just a notification of intent? if it is the latter then set a court date, get a lawyer, tell him everything and i mean everything, and proceed to court.

have you had many tickets in the past or is it just these 2 since you started driving? that may have leverage when going to court!!

amazing how you can get ur licence taken away after two speeding tickets. On the other hand you can't get it taken away after causing a number of accidents. I know a someone who's got into 4 accidents(totaled 2) and still is able to drive.

yea, they should have statute about taking away a license after a certain amt. of accidents!! i have lost count of how many tickets i have had and been in two accidents which where not my fault at all and i am still able to drive, plus i have grown up a lot, that helps too!!

damn NY sucks, you can get more than that here in California, have caused accidents and maybe even a dui and still drive lol! Well I think that 5 hour course won't do crap because you missed your court date, if you showed up everything would have been ok. Frankly the court is going to put the blame on you because you should have known that you had an upcoming court date, that you should have notified the court of a change of address and therefore you really have no excuse. Missing a court date for ANYTHING really just puts you in the *******. Well think of it this way, if you can't drive for 6 months, you will save hella on gas and be able to buy new parts.

I got a lawyer and he got my completly out of a 130 in a 55. so yeah if you can get the right lawyer you will win no matter what lol. i still went to jail which sucked but i got out of the ticket. so get a lawyer. before the 130 in a 55 i had a 55 in a 35, 65 in a 35 and 2 seat belt tickets, so yeah he was pretty good. All i had to do is take that class you speak of. The only thing i learned in that class was how to aviod cops. There was 2 pilotes in there for doing 135 in a 35 on crouch rocktes lol.

they got caught on street bikes? Pitiful. Cops arent even allowed to go near street bikes when they are giving persuit, much less they have liscence plates the size of cell phones and the ability to outrun any cop car regardless.

Will my points be taken off of my license even though its suspended? I took the course when I pleeded Not guilty and than a few monsth later I pleeded guilty because I thought 4 oints would have been taken off my license which only gives me 10 in total; which means I shoudnt have a suspended license.

imo you should learn to drive more carefully so you wouldnt be in this dilemma. id say listen to the others and get a lawyer, thats your best bet. good luck.

dude,,,call my lawyer hes good as hell,, i once broke a mirror in my house and was supposed to get 7 years bad luck,,my lawyer said he could get me 4.......hhehehe

call the dmv, they might just be suspending your licence for not showing up to court, that seems too harsh for a 2 year period... call up the dmv and ask whats up... over here in LA, i knowpeople with a crap load of speeding tickets, street racing, blah blah blha, and they still some how have their licence...

how the hell does your point system work?? i know in ontario you can get points added but the most i've gotten was 4.. and that was for 120 in an 80 zone.. but never heard of 8 points or more..
