Uninsured motorist

I would like to rant and vent a little frustration, as well as ask a question. So I appologize for the bad spelling, comma splices, and choppy sentences. I had just recieved my car back from the glass shop yesterday, at about 12 oclock in the afternoon. I still am awaiting inspection so I havent driven it since I had the rear body damage caused by road debris off of a main road. Im sitting watching tv, when I hear a loud metalic bang, similar to a trash truck droping its metal trash bin. Then my car alarm goes off, I run outside and see smoke coming from behind my VAN, I hear yelling, so I walk to inspect, and see a young driver angerly jumping around. I calm him down and inspect the damage. His car was under my van, the force had sent my van into my 02 civic. I asked him if he had a drivers license. He said NO, so I called the police department. When they had arrived, he magicaly had a drivers license, but the car was not his. Police took information for me, checked for warrents, and insurance. Gave me a policy number. When i contacted his insurance company, he did not have a vaild insurance policy, it had lapsed in july of this year. (Ranting done) (question begins) His car is still sitting infront of my house, I told him he had a few hours to figure out where he wanted it to go, arrange for towing and tow it. If he doesnt pick it up today, i want to call for a towtruck and have it impounded. If I call his house would that be enough notice to waive my liability in that matter, or is there a process of warnings needed so he cant just say.... HE OWES ME THE IMPOUND FEES. This guy is very unremorcefull, and even brought his friends to my house to show them what he had done, gloating almost.... (of how big of an idiot?? ) I want him nailed to the wall. I was told that my insurance company would take care of him, and sue him for the funds, however if there is anything I could do as a victim to an uninsured motorist I would LOVE to do...... Thanks. Now the claims ALLLLL over again

Call the city to report an abandoned vehicle, they will do the rest. Not your problem.

Hopefully you have uninsured motorist to pay for your stuff, that is probably the only way you will see money. The insurance company will do the rest and go after the dude.

What about suing him for my deductable(s)? do i have any right to that..... yes i have uninsured motorist coverage, so im set with that.... i have full coverage on both with a 250 deductable, althought they say i need to pay deductables on both vehicles.....

yes you can sue him. If he smashed into you, he needs to pay for that. Since he doesnt have insurance, then suing him is a way for you to get money.

actually no you cant sue, at least for bodily injury, that's where the money comes from in the suit, and since you have um on you policy there will be not deductables involved, besides even if you did sue for lets say something like mental anxiety or stress there is no ins company to sue, just him, and if he doesn't have ins he probably doesn't have any significant assets to try to go after either. **** like that happens just be glad you have um on your policy, it saved you 250 bucks

you can sue him, wheni titaled out my old car the lady who ran the light had a lapsed policy. we took her to small claims court becasue it was a 92 corsica. but still got $3000 out of it. stupid people with no insurance should be shot.

he wont be suing for bodily injury, he will be suing the person because he hit his car and damaged it. And the other person aparently doesnt want to pay and has no insurance to pay. Usually what the court will do is if he the person who got hit wins the case, the court will either give that person a certain time to pay or the court will pay the person and make the loser pay back the court.

Yes you can sue. But like stated above, you will have to go to small claims court for your suite. Just kepp any receipts such as car rental, tow truck etc.. If you have to bum rides from friends, keep track of that and count the bill similar to a taxi service. Your suite will fall into a burdern/harship category. Your problem with the suite is that the money you sue for will more than likely be payed over a series of payments. I had my car broke into and around 1800 worth of stereo equipment and interior damage was done to my car. They caught the jerks who jacked my car and then were ordered to pay restitution. I ended up getting about 50 a month for about 2 years and then for some reason never received anything else. Since I had already moved out of state, dealing with the process of tracking down the subjects for 50 a month seemed pretty stupid, I just left it alone. Good luck.

streetglower, you are right, he can sue in small claims court. but since he has um on his coverage it would be a whole lot easier for him to just let his insurance company pay to have his car fixed and then his insurance will sue for the money that they had to pay out. he wont have to pay anything out of pocket to fix his car or have to wait for a court date. and if he does file a claim with his ins co. he won't be able to sue to.

Yes he can. An insurance company will pursue the uninsured motorist for the money to repair the vehicle(s). However, the insurance company is only going to repair the vehicles and they may cover the compensation for a rental, although highly unlikely. The fact of the matter, the personal issue for punitive damage compensation will be left in his hands to pursue in civil court. His/her insurance matter has nothing to so with his choice to pursue a civil suite. An example: If you wrecked into my vehicle and I suffered bodily damage, in ehich your insurance company decided to only cover x-amount. I would have to take you personaly to civil court to receive the additional money to compensate for my medical bills.

Update- The insurance company came out to my house checked out both vehicles, and informed me of the following:

For one I do not have rental coverage normaly, due to the situation, I will be provided a rental car. They will cover all of the bills to repair the car, and issued a 900 dollar check for my 1984 Ford Econoline van (car 1 that was hit). They will sue the driver for the repairs, as well as deductable for me. He had abandoned his vehicle infront of my house after the accident, so I contacted the abandoned vehicle unit with the MCPD, after two calls....(the second i explained oil was leaking and I believed it was polluting the near by drainage system that directly ties into the chesapeake bay water) they towed it within hours, incurring the driver fines, and impound fee's. If I am not mistaken, the driver will incur penalties agaisnt his driving record as a result of driving without valid insurance.... His lack of respect for my property, his attitude towards the situation, and his carelessness I believe has got the best of him. Im waiting for photo's to be developed, I will post pictures of the accident scene asap. Thanks again

If someone had hit my car in front of my house and then left there car there, I would have put a for sale sign on it and sold it for cheap to the mexicans. They dont care about a title, they just want a car. Running or not. They dont ask any questions and will buy anything with cash. Thats how we sold our last car. Within hours of putting it up for sale in front of our house, a few guys came by and paid cash for it.

Screw calling the cops on it. I would sell it, then sue him. And tell him maybe his car got towed, who knows.
