it is illegal or legal for landlord kick you out for...

My friend just got kick out from his apartment/house because her friend come over for past 2 days. She told me her landlord give her 10 days to move out because her landlord thought her friend is living here. Her friend probably stay over for a night homework help or something. This afternoon the landlord use key and open up her room when she not even home. What is the reason the landlord do that? Stealing money or stealing whatever she could find. The landlord find her friend in her room and her friend call her up and said the landlord is kicking you out.

My guesses is the landlord went in her room to steal stuff, and end up got caught. The landlord making bs and try to cover it up.

It is legal/illegal for them to just go into your room without a permission? Do you think this could bring to court and try to sue them.

I think this is kinda messup.

i would call the police and settle it thru them. what the landlord did was really fcuked up because hes invading privacy and he suppose to knock the door before entering cause anyone could've been home.

just because someone got friends doesnt mean he gotta hate cuz the landlord is a loner. did he really steal tho? if so, what.
he doesnt have proof she is living there either.
time for small claims court and definately talk to the police or someone who can handle it.

from what i've heard, it is not legal. the landlord is required to give you previous notice that they will be coming by before they do (they have to ok it with you first). your friend should just talk with a lawyer, and find out. it's a question that a lawyer should be able to answer with just a quick phone call.

yeah in california, there suppose to give you at least 24hrs notice before entering your apartment. They also have to give you at least 30days notice to move out. Check your county laws.

i found some quick links for you. Best way is talk to the local real estate authorities about it though or contact the california consumer department

http://www.dca.ca.gov/legal/landlordbook/

http://www.dca.ca.gov/legal/landlord...is_summary.pdf

http://www.dca.ca.gov/legal/landlord..._companion.pdf

They links show that the landlord is already in violation by just coming into your friends apt. The landlord is only allowed to into the apt in cases of emergency, repair or giving prior notice.

good luck, i hate shaddy landlords, i've had my fill of them too.

She should have been served an eviction notice, but either way its a civil matter, nothing criminal about it.

Thanks for the help, i will look forward talking to the landlord. It isn't my problem but i just helping a friend out. I don't know what it call it like a house with rooms. My friend just ranting a room. I just wondering for landlord can have a room rant out. Do they need any kind of L to rant room out? What happen if they don't have L, can we do anything about it? Yes she a shady landlord probably want to kick them out for more money.
