A way to get out of a TICKET!!

Its all about reference points..ok Here it is my story told to me by my gov teacher today at college..

When next time your pulled over and you ask the cop to give you his point of reference and he doesnt have any..you can take him to court and always win under the 4th admendment..which states..
the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Many of time has this been trialed and always won in the side of the person being convicted..

like lets say... your driving between 2 trees...the first tree and the second tree are 100 ft apart..the cop uses these two "points of reference" to gauge ur speed...so if he dosent have these two points.. he cant accurately gauge ur speed inless he rides up behind you and physically has to gun it to catch you....

the 4th would only help you in a search and seziure not a speeding ticket tho. also if he has his dash cam on it has a gun built in if i remember right, so he would have your speed

im saying in the case if you see a cop just pull out a gun and clock you..with not apparent reason for doing so..his cam wouldnt pick that up..and he would have no point of reference to use so how could he accurately gauge your speed?


thats like if you ever had a radar gun..i used to play baseball so i messed around with it... if i took my hand and wipped it in front of the gun it would register at a high speed even tho my hand couldnt be possibly going that fast...

oh yru talking about a cop without a radar gun and not even pacing you? i wouldnt think cops would bother if they didnt have proof. most cops that pull you over are gonna be able to show u the digital read out on their radar/laser gun. but i'll still rep ya.

he's saying that if the cop has no refernece point to gauge your speed first, he had no right to even "gun" you in the first place. the action of using his gun against you is protected by the 4th amendment, cause it is tecnically a search of your car that he had no basis for.

alright, this is a story my best friend tld me about his trans am buddies.. hes a guy that wouldtn lie cause hes brain power is uncapable of actually being creative...

story goes... buddy was speeding excessivly down a side raod. believe it was somethign like 85+ in a 25 or 35 zone... driver of trans am seen the cop.. immedialty pulls over, pops hood and jams throttle body open... revs and bounces of limiter... cop comes over and gy starts to spaz. talks about how his car wont stop from reving... undoes what he did to make it rev and cop let him go.....



now i wouldnt mind trying that cuase mine would go to ony 4 grand... casue i dont know about letting it sit at 8,400rpms for like 40 seconds or wahtever...

if your car is modded, then he has probable cause to search your car and your engine bay. since the engine bay isn't considered a place of privacy, they can open your hood and check it out.

Ive never heard of reference points before and Ive won all my Radar cases...no reps for you b/c thats dumb

Thats nice, but it doesnt work exactly like that, at least here in So Cal. Cops run speed traps that are so obvious and still catch people. Ive seen a cop parked in the middle of a street. If he has a laser gun, the only chance you win is him not showing up or not writing in on a Trial by Written Declaration.

i got a 52 in a 35, cop wrote it off as a 9 above so its only $83.50, it says under comments "stationary radar" sooo does that mean i could have asked him what his reference point was...is it too late for anyway to get out the ticket, well let me kno

could i get arrested or some sort of citation for getting out the car and have a few words wit the officer...like "ur an *******/jerk/etc."...or..."you cops are horrible"...lol i was so about to do it i was extremely pissed, it was first day of my spring break, no work, no school, omg i was so ****in pissed.
well alrite i mean after i get the ticket, and he marked it down a bit and i signed it, lol...what if i got out the car, n had a few words, what would happen?

possibly disorderly conduct or obstructing justice, all depends on the state statutes.

Also need to look at it this way.

If he sees you hauling *** down a school zone, he can pull you over and ticket you without needing the "proof" of the radar gun. He brings you to court, and he shows up.

Then its your word against the police officer's.

Best way to not get a speeding ticket is NOT TO F'ING SPEED. I don't care if you're a "safe, fast driver"... that's B.S., just more kids thinking they're invincible... and yes, I'm probably talking about YOU.

^are u tellin us all u never got a speeding ticket? Sometimes speeding is caused by velocitating and im sure everybody does that once in a while, speeding without realizing/noticing it. Then of course there are people who speed intentionally. Chill wit the way ur wording ur posts. It's nice to be thoughtful and state ur opinion on speeding n convince people not to, but then this part:

Nope, I got one too. 79 in a 65. I managed to talk the DA out of putting it on the record, but did 10 hours community service and paid some odd $150 total.

I apologize if I offended you. Yes, sometimes we speed without realizing it, but there are several people who speed because they think they're mario andretti or something. Those are the people I'm talking to, and they use the "I'm a fast, but safe driver" claim to justify generalized unsafe driving.

If you get pulled over, and you claim "4th amendment" to a cop, he'll detain you and search your car just to spite you. The reality is, if he pulled you over, he probably has all the "probable cause" he'll ever need.

Take him to court, and the judge will laugh at you too.

ha, i feel ya on that. jus wanted to clear it up. to be honest, i use to speed and i got pulled over one time. my boy was in the backseat n a girl i was talkin wit was in the passenger seat, the officer talked wit me outside the car and asked if i really want to risk getting into an accident and have if not myself, but my friends hurt n fly through the windshield. this cop was awesome, instead of being a **** and jus giving me a ticket, he actually talked wit me. so after that i really did stop speeding how i use to. yea, speeding is bad.
