Penelty for Fighting??
I think I'm gonna need to fight someone. I'm 99% sure I can take this person down so it wont be much of a fight..... I'm gonna keep the reasons private.
I want to know the penelties that I could face for this. If someone calls the cops and I get arrested for fighting in public what could I face? Can I get a jail time or would it be just some stupid small fine?
Reaosn I'm asking is because I never got into a fight outside of school.... in school when you're under 18 nothign happens to you. So here I am, 20 years old and not a minor..... what could I face for fighting in public and possibly hurting the person?

Get thrown in jail for a day or two or even fine like 200 and somethin. Unless you're a prior service member like me, you'll do prison time or be fined more than 200 because u were trained to kill.
Theres your answer because I was charged with battery and assault once.

haha, depends on how much u fvck him up and if you use a weapon.
Don't use a weapon of any kind and just toss him around a bit and give him a few shots and call it a day.

i'm no service member so i dont have any assult skills they can charge me with. it'll be an old fassion amatuer street fight over a girl lets say.
since the penelty isnt too severe then its definatly worth it cuz this focker deserves much worse.
thanx for the reply

let him throw the first punch, then it is just self defense for you. Call him on and make him throw it if you have to. DONOT kick him, that is assault and battery with a deadly weapon. This way with him throwing the first punch, if he does in fact kick your ***, you could press charges for assault and battery with intent to do bodly harm.

he will not throw the first punch..... this guy is the type of person who talks too much. i will most likely just say that i was defending myself...... let them prove me wrong.
so kicking is assult and battery but punching is not? so if i just use my hands i will have less problems?
oh god its over for me. I do taekwondo which is like 95% kicking oh man if i get in a fight it'll be like stabbing the guy like 100 times. If your a black belt in any martial art and you get in a fight, i heard its like your fighting with a weapon. Black belt = weapon and i would agree to let the guy punch first so u can call self defense.

don't throw the first punch......
edit: well i read your post where you said he won't throw the first punch....so do this. However the fight gets started....throw your "WEAK" hand in the air therefore distracting him and then catch him with your "STRONG" hand.....im serious.

make sure you at least have witnesses because he can always say that you assaulted him. dont do anything that is not neccessary like kickin his *** too much, which im sure he deserves it, because if you mess him up bad he can press charges against you, you never know he may just take all the hits just to screw you over in the end, i've seen it happen. if you say you can easily whoop his *** then i would rather punk him around and just embarrass him in front of the girl, if she is there.
i am assuming that he is over age as well and dont let anyone who is a minor get involved like any of his friends or anybody cause that will sh*t on u for sure.
last but not least, record it and later host it on site so we can watch. good luck!

Well aside from jail time, not only will you have to deal with criminal court, but he could take you to civil court. Say he does this and wins (which is the likely situation) you will owe him money and if you can't pay it, they will garnish your wages, take your property, etc. Also, if you ever plan on getting a real job in your life, when they run your criminal record check, you'll have to explain to them why you have a battery charge on you record. There are a lot more consequences aside from spending the night in jail. So hopefully you think this through.
I don't know the law where you live but I got held overnight and given 6 mos. probation for an assult and battery. In a different situation I was in a fight outside a club and got stabbed 5 times and spent 2 months in the hospital. The guys were arrested and charged with attempter murder, pled out and got 10 years probation...not a single day in jail.
is pushing an act of assult? if not i'd push him(using one hand) in the face.. that way he would get embarrased and prolly throw the first punch... and have someone record the fight dammit! i wanna watch!
Don't drink and post, you will end up hilarious.

You guys must take the judge for an idiot
One can only guess the number of guys that try to use the "He threw the first punch" excuse only to appear in court without a nick on him, infront of a judge.
How are you gonna prove this, its your word against his unless you got witnesses, and witnesses need stories. And how do you think it will look when you show up to court without a scratch on you and hes beaten to all hell???
Unless you have it on video you can't prove self defense. And even then from the way you two will fight its obvious what you two are there to do and the fact that there a cameraman more concerned with filming than breaking up the fight. Now that is unless you simply plan on confronting him and beating the crap outta him.
Now days even holding up your hands to defend yourself is considered fighting back.
He if feels like going to the cops then your fuked, if he feels like sueing you then your really fuked.
My advice 1) don't get caught in the act, 2) hit him in the stomach as much as possible. more than likely the first hit will knock the wind out of him and after that he can't take much more. It by the time time he tries to call the cops any red marks or small bruises on him will have gone away. 3) If he has witnesses, be sure to bring your own, but not too many. Your average judge can put 2 and 2 together and conclude 2 guys fighting with a bunch of people around in an abscure place, are obviously there to fight.

You never know how the law will work out. For instance, i was charged with disorderly conduct, got 2 weeks house arrest, 500 word essay, and 15 hours community service for throwing a cheeseburger out my window at some lady who pissed me off.... yup, thats how is goes sometimes

I'll give you the felonies you could face, instead of the misdeameanors since they have been mentioned already:
Here are some possible charges you could face, depending on the situation, the cops, the DA etc.:
Assault (if it stays verbal)
Assault & Battery (if you threaten and then actually touch the person)
Aggravated Assault & Battery (Pre-Planned, and posting on the internet is not a wise thing to do posing such a question)
Assault & Battery with a Deadly Weapon (A Deadly weapon can be your shoes if you kick said person, on up to a gun)
Aggravated Assault & Battery with a Deadly Weapon
Aggravated Assault & Battety with intent to Maim or Kill (depends on how bad you kick their ***)
Aggravated Assault & Battery with a Deadly Weapon with intent to Maim or Kill
Mayhem (if you lose total control of yourself)
Civil Lawsuits for Damages
This may sound like a stretch, but I've seen things escalate in these ways in cases. This is of course if police arrive on the scene, and they play an important factor. If they have had a rough day and you give them the wrong attitude, your *** is grass and they're the lawnmower. In my line of work I see it all the time. Being a **** or arguing with a LEO is just plain stupid, even if you are right, as they are the ones who write the reports, not you. It can also lead to resisting arrest, assaulting a police officer (or a Federal Agent if you hit me
) Save that for the court case.
My word of advice is to avoid doing it in public if you can, without any witnesses or not do it at all. Having charges on your record for a violent crime will be a stigma attached to you for the rest of your life.

Like you said it's not a fight if you can take him down that easily. The only thing you'll be is a bully. You're not in high school anymore and your considered an adult so act like one. Just imagine you kicked his *** and this tiny person "that you can easily take" dies do to bodily harm. Now it wouldn't be a domestic violence charge, it would be murder, so think about it.

TMkarip, thanx for the helpful info..... i didnt know fighting could result in such serious problems and now i'm not sure if its worth it.
i think i have been in the same situation as you and i beat the **** out of the guy, if the guy knows he deserves it he´ll probably do nothing afterwards, i mean he´ll fight back and everything once you start beating him, but i doubt he´ll sue and i doubt he´ll call the police. this is just from my personal experience. just do it.
Expect to pay all his doctor/hospital bills. He'll probably go even if he doesn't really need to.
What ever that amount is, times it by 3, and that's whay you can expect to pay for pain and suffering.
If you want to throw that kind of cash around, have at it.

the object is to not get caught, if he's any kind of a man then he'll respect this and probably fight you and get it done, if he's not for fighting, i'd avoid the whole thing. of course, if your one for big crowd's to cheer for you, or to win over some ladies, then chances are with all those witnesses your hit anyway. you could smoke one with him and call a truce... peace isn't cool these days though heh.
i bet you can raise holy hell on this kids face, and nothing will happen. If the cops come, they will break it up. If he presses charges, chances are they will be dropped sooner or later, and you will be home free. With all the crazy **** going on in the world right now, everyone isnt going to drop everything and pursue a little skirmish. Fight on bro
