How to prove innocence
OK Me and my friend our driving down a 2 lane road in our cars, him in front and me behind. We approach a three way stop by ourselves. We are both going straigh BTW. He gets moving and while he's just exiting the intersection a truck is approaching the stop. Well ive done made a full and complete stop at the stop sign while the truck is still 15-20 feet away from his stop sign. It had been raining so the roads were wet so i take it easy off the line. Well the truck just coast through the sign and I have to stop in the middle of the intersection to avoid hitting him.
Well i figure if he wants to be in front of me that bad imma make it more enjoyable for him by flipping on my brights.
Well he figures he's gonna **** me off by going 30 in a 55 zone. Im in no hurry and its just more time for me to light up his rearview. We are going through some turns so im not about to pass him at the moment to I wait till the straightaway to make my pass. Well here comes the straight and I downshift nd check for oncomming cars. Its all clear, so I go for the pass,, as he's still doing 30 in now a 60 zone mind you that he has no turn indicators on and its apparent that he plans to continue straight. Well as he sees that Im going for the pass, so he waits till im even with his bumper and he slams his brakes and cuts left AT ME! onto a side road. He narrowly missed me by a couple inches. This was an accident narrowly avoided.
WELL.....
I look in my rearview and just as soon as he turned off and almost hit me, he cut through a gas station and looped around back onto the road. Where he followed me a bit until an intersection where he turned the opposite direction that the side road would have taken him.
Now its obvious that his destination wasn't in the direction that the side road would have taken him. And that he wasn't in the gas station to get anything.
However im curious. In my mind i believe that he swerved at me with the intention of hitting me. He missed so he simply continued on to his destination. All evidence would prove this also. BUT had he hit me it would appear that I was at fault because I tried to pass him while he was attempting to make a left hand turn.
So how would one prove that this man purposefully invoked an accident?

1) The truck made no indication of turning, be it either slowing down to turn or turn indicator.
2) The truck only felt the desire to turn once he knew that I was attempting to pass
3) The truck had no buisness down that road because he immeditally turned off as soon as he missed me. Had the truck been lost and just made an emergancy exit to stop and get direction, he would have had been there much longer, at least got out the truck.
4) The truck followed me to a major intersection and turned onto a road that lead in the opposite direction the road he suddenly turned onto, proving that his original destination was no down that road.

I dont know.....you could just argue the case cause he did not use a proper turning signal and also he was going so much under the speed limit the whole time

Hm...Im gonna take a stab at this...
When you were following the truck was there a broken center line? or was the line solid? my question is were you in a passing zone or not...
If an accident had happened it would your word against his...and the police officer would have to hear both sides and believe me...both sides are always very different
the police would map out the scene and make measurements...investigators can figure out a lot by looking at the damage on the vehicles and marks on the road.

You would have to rely on some type of witness or something if no one wa around it would be him versus you and it would be considered an "accident" and neither of you would be consdiered at fault for the accident

One question, was it legal to pass him where you did? If so then the crash would have been 100% his fault. why? Because its his responsobility to check to see if its safe to turn where he did as in He's suppose to check his blind spots. If not, and you were passing him where you shouldnt have been then its your fault.

it had just turned into a broken line as we got out of the last turn and onto the straight away. Zzyzx, I was always told that if your passing someone and theres and accident, the person passing is always at fault no matter what.
