tell me what you think should happen about this court case?
In august of 2002, I was at a friends house with my girlfriend when we got in an argument and I hit her. I left after it happened and later I talked to the cops and they said that her dad filed assualt charges, but they weren't going to arrest me. Well a few days after it happened I went to the sheriffs dept to file a incident report because when I was at that house, someone there threw a bottle at my car causing damage, when a detective wanted to talk to me about the assault. I told him that what she said was true, and I filed out a police report for that under alot of stress. Well a few weeks after that my girlfriend ran away from home and stayed with me for one week. After that week she finally went home and told her parents she was with me. A detective called me a day after she went home saying I had a warrant out for harboring a runaway. So I went and paid the bond and eventually went to court a month later where I recieved probation for 2 yrs., had to pay $500 plus court costs, do 100 hours of community service, report monthly and take urine tests, etc... Well 2 months after I recieved probation, I was pulled over in houston and arrested for a warrant. The warrant was for the assault case. This happened in November. Well I posted bond in jail and went to court in december of 02 for the first time. Now it is febuary of 2004 and I got off of the probation from the other case early because I completed everything and I still go to court for the assault case. Now they want to give me more probation for this case. 1 yr, 80 hours of community service and $300 fines. Well what I want to know is do you think it is right I should be givin probation again? I mean I was already on probation for one yr and completed everything and didnt get in any trouble, so why should I go on more probation. I was talking to a friend today and she said it is bullshit for them to give me more probation. The assault case happened before the other incident and basically I did my probation, and paid over $1000 in fines, and I dont even talk to this girl anymore, since I was givin probation. She is not part of my life anymore. What do you all think?

I think it is messed up because I already got 2 yrs probation at the same time the assualt happened. I think I have served my punishment. I have a lawyer who used to be a DA. I dont want to pay anymore money, I have already payed over $1000 on the other case. Where is injencivic, I want to know what he has to say.
from my understainding you were covicted of harboring a runaway. you recieved and served 2 years of probation. im assuming she was a minor at the time and so were you.
since the assault charge was from a separate incident they can still prosecute you and convict you with aditional punishment. remeber that just because u already served time for one crime it doesnt exempt you of the others that you may have committed. you are not being charged with assault alone, do to the fact that you had physical contact with her. hitting her will result in assult and battery. assault is stuff like pulling a gun on someone, pretending to hit someone, etc. battery is the unwanted touching of another. so basically when u cocked ur arm back thats assault. when u hit her thats battery.
one more thing. check to find out your states statutes of limitaitons. it varies from state to state. basically there is a time limit between the act in question to the actuall law suit. here in PA its 1.5 years. so if u are here in PA and you served your 2 years probation and now they want to convict you of your previous assault adn battery question. it would be unadmissable since its late by 6 months.
