speeding in norcal
In april i got a ticket for going 85mph in a 65mph zone... i went to court today and the judge said that i can't do traffic school because of a law thats says 20mph+ = NOT ELIGIBLE FOR TRAFFIC SCHOOL!!! so my question is.. what happens to my record and ensurance?? this is my first ticket and i have no knowledge about this situation.. also, is there anything i can do..

ive never heard of ensurance, so i wouldn't know! haha...but when your INsurance runs a MVR they're going to see the point and charge you. they don't run MVRs daily though...so you might be ok for a while. dont go telling your insurance company that you got a ticket! haha let them find out on their own. if you change insurance companies though, or get a new policy for some reason - they'll run 1 for sure as a 1st time check type thing.
you'll get a point - or two, on your record. no biggie other than having to pay more $$ for insurance! unless you start accruing a lot of points, then they can take away your license and start to discipline you for your bad driving habits.
did you really tell the judge you were going 85? ive heard you can plead guilty in exchange for a lesser fine or no points going on your record. ya know - like in a murder case, if the defendant pleads guilty they'll make a deal with him - or he can go to trial and take his chances at getting off scott free or getting a worse penalty than he would had he plead guilty in the first place.
i would always plead not guilty. BUT if i was in a situation where i knew i was going to lose i'd probably say soemthing like "sir, i admit i was speeding, but i was NOT going 85." then kinda bargain from there.

i got my ticket for speeding back in march. i was going 80 in 65. since you already went to court theres not much you can do for bargaining or changing anything. you'll get 1 point on your license and your insurance will go up approx. $25 and it will be on your DMV record for 3 years. my advice, get a radar detector next time.
also FYI for everyone, pleading guilty will NOT drop your fine for a speeding ticket.

ya that sounds more right - plead guitly, get a heftier fine - but have bargaining room for points on your record. i know there is a way you can bargain for getting no points or less points than you would have gotten for a particular offence

Yeah that 20mph+ rule is a new one. Sucks that the cop actually put your speed on there instead of bumping it down so you can at least get off with school. GL

1mph less and you would have been in the clear. In fact, usually a cop (or a court) will bump it down, especially if you don't act like a jerk to him.

When you are arraigned(sp?) thats the court date on the ticket plead not guilty. You will be asked to wait then someone will call you in to the hall. Then you talk to an assistant DA that looks like they passed the bar yesterday. He is the guy to haggle with. If you already have points he wont. If you have a clean record you may get off with less than any other option. Or you can plead not guilty by writing a letter and paying your fine in full. The idea is that cops are piad over time to go to court but they get paid just the same to drive around as they would to write a report as to why you are guilty. So hopefully the officer says screw it and goes to lunch rather than write a report to the court. If he doesnt respond you win, get your money back, and have nothing on your record.
