F*** Help hey guys today i was going to school and i got pulled over. while i was pulling over i bottomed out on a speep bump at the gas station we pulled into. well anyways i got a ticket for doing 80 in a 60, and the cop laughed at me for my car being too low.
on the ticket it said i drive an accord...obviously i dont...can i fight it based on that simple fact? i cant go to traffic school, hasnt been 18months yet...
what should i do?

btw: to make things worst, its my moms b-day and she has to go into surgery today...damn i wanna cry

Rep Power: 350 You might be able use that. Bust out the registration on the car showing the license plate #. Then show that the car on the infraction does not match the car in actuality. Check what they put for the color of the car, how many doors, etc. etc. Might work, but not a for sure.

Rep Power: 294 doubt that would help your defense, and the violation occured before your 18 mos was up so that wont help you. errors sometimes happen on summons, but also he has a report, radio traffic and if his car was equiped, in car video to corroberate his story.

Rep Power: 0 The best way to fight off any ticket is to file for extensions. They allow you one extension of 2 months on your first plee. This is what you do:
1/ wait till the ticket is almost due, then call in (be put on hold forever) and file for an extension
2/ when the extension is up, write a check to the courthouse to pay your "bail" and on the check write "NOT GUILTY" include with your check a letter saying you want to contest it. Along with that paper, write a date that is the best for you. Try making some excuse like you'll be outta town for business between *date* and *date*. Sometimes they will work with you on the dates, but sometimes they won't.
3/ "DAY OF COURT" Before they try you for your violation, they will take roll. When they call your name they will also see if the officer that cited you is present. If the officer is not there, then they automically dismiss your case. If he is there, then they will tell you if you are eligable for traffic school and give you the option to take it or not. Then they will move on to trial.

Rep Power: 350 Actually, depending on the court, if you show up for the trial, they will not give you the option of traffic school. I tried what inovatv said in whittier and they called me up and proceeded to trial and when I asked about the traffic school they said that by paying for the bail and stating not guilty, that I forfeited my right to traffic school by fighting the ticket. Just tossing some more 411 out at ya.

Rep Power: 0 If i remember correctly, if the cop puts any incorrect info down on the ticket especially if the make of your car is wrong you can fight it and most definately win. Tickets are legal documents that are indisputable so if the info is incorrect then the ticket should be thrown out. Just ask for a court date and then just take proof of what car you were driving that night and the rest should take care of itself.
