if theres structural damage the car is considered totaled. usually when thats the case insurance companies wont pay to fix, but would rather pay for the car....the sucky part is that the lady dont have insurance.
i guess suing her wont really accomplish much either, huh? sux dude...good luck.
go see a doctor...you might have other damages/legal claims...

Yeah, when I wrecked my 2k1 vic I had a little frame damage on the driver side. The insurance wouldn't total it. It was a total of $10,000 worth of damage. After it was fixed it never drove the same. I see a big law suit for you and a free car!!!!!!!!!
If you insurance does want to fix it(like mine did) than sue that lady, take the money you get from the law suit, trade in your vic and buy whatever you want.

Actually, what will most likely happen, as my friend had the same thing happen to him. Your insurance will most likely give you nothing, and since she has no insurance you will get nothing from her without a tort suit. The car will probably be totaled out, in which case the insurance company still might not pay you jack, and your insurance will go up, just becuase it is a registered accident, your fault or not, whether you even call them or not, they find out, they charge you, plain and simple.
Go see a doctor and find out if anything is wrong, just check with the doctor. If something is wrong then call a firm in your area and have them file suit against this women, assuming you have some info about her. Sue for damages, any rental cars fees, etc.
If she is driving without insurance she is at fault for the accident, regardless of who hit who, that's the way the law goes, since she did hit you, she is up s**t creek without a paddle, the law is 100% on your side in this matter.
Talk to a doctor, find out what the damage is if any to you, and get an estimate of the damages on your car. Once those are settled or even before talk to your insurance company if she will not pay. If she wont, then you sue for damages attributed to the repair of the car, doctors visit(s), rental fees, compensation for days taken off from work due to injury, and so on.
Keep me posted on whats goin on.
If you have any questions just pm me.

well i'm gonna call the insurance company tomorrow... and by the way... i just dropped my car 3 days ago...
A friend of my wife's was in evolved in an accident a while back. She did not have insurance at the time. The other persons insurance paid out his claim and then went after my wife's friend to get the money they had paid out. It will depend on your state laws on how your insurance will deal with your car and the type of coverage you have. If your insurance keeps f@cking with you contact your state insurance regulator or something to that effect. They over see the insurance company's that operate inside the state. And check to see if your state has what is called diminished value claims. What it dose is after you fix your vehicle you can have it appraised and it is appraised or even if you sell the vehicle and you get less then fair market value the insurance company will have to pay the difference. The thing is not all state have this law. Good luck, hope you feel better!
That sucks I got hit in Phoenix back in 2000 and the motorist didn't have insurance and had 2 driver licenses. But yeah they tried to put me at fault but thank goodness that didn't happen. But yeah the insurance went after him and got the $$$. But yeah I was sore for a couple of days but I never went to see a doctor, didn't want to waste my time.
Yep the drivers side got hit so they had to get a whole new door and paint and re do all the electrical stuff.

CGodWin is right. The report should tell all the details and seeing she doesn't have insurance, that only means that there is no company to pick up the tab. So now that you have your lawyer, dig deep in her pockets; unless real high ethics are important. But then again, shes the dumba$$ driving without insurance, which is illegal in all 50.
I hope this doesn't mean we'll be short 1 member some time in the near future.

That is the unspecified part. If your insurance company does pay for the damages it will go after her for payment of expenses to you, in that situation however you are a third-party if you have any involvment.
There have been cases where insurance might still cover if you just droped.

No no no. If you wreck your car and you have insurence. They will pay to fix your car or drop you. Depending on the accident. Now if the value of your car is less than the cost to fix it... They will total it. And give you the amount of the value of the car. If you have a loan out for the car they will pay that loan off. If the value of the care is greater than the cost to fix it, they will fix it. Even if the other person does not have insurence. Well, that is how my insurence, AllState broke it down for me. Something about being in good hands or something.
