2002 Honda LX - Lemon because of noise
Hello,
Just wanted to let you all know that my brand new LX was making a noise a lot of you are describing on the forum. They kept telling me it was normal, and I wouldn't put up with it. I took it to the Florida lemon law after I made three attempts to have it fixed. Honda bit it big, and their lack of customer service was horrible. If any of you need help on this matter let me know.

Forgot to mention, that it was "gear lash in the tranmission causing a whinning noise i.e. harmonic vibration". And yes I did win through the lemon law and Honda had to buy back my Civic and pay on top of that.
"gear lash harmonic vibration/whine" ? I don't think too many people have described that problem here. Lots of strut and 2nd gear problems, but this is the first I've heard of yours. Good that you won your case, though.

You have a brand new car. If it has a vibration in the "seat" have the tires re-balanced. You might have had the 4 orginal tires balanced from different balancing machines at the factory which could give you a set of "Off Balanced Tires". I had the same problem when I bought my car, I just bit the bullet and spent the $25 to have the wheels rebalanced on the same machine. You might beable to get the dealer to do it for free but don't count on it. I had mine done and after it was like, SILK on the highway.[IMG]i/expressions/face-icon-small-wink.gif[/IMG]
What problem are you describing? You are lucky Honda bought back your car. How long were you in litigation for? Did they pay you civil penalties too?

I was in litigation for about 2 months after I tried all possible solutions to get the car fixed, have honda buy it back, offer to buy
an accord if they buy back my car, etc. After three attempts to have
Honda fix the car, after they kept saying it was normal, I pursued the
lemon law, represented my self, and went against Honda. I won, and each state is different, but I got every penny I spent on the car and then some. I got license and registration fees, tax fees, tires fees, etc.
If any of you in the above listed forum need help I have researched this problem to the nth degree and can help you. It's a flaw in honda's gears in the lx models and the fact that they use an aluminum transmission case that causes this annoying noise. It's louder in some cars than others.

I am just curious what avenues you persued. Did you just get lucky and Honda said ok we will buy back your car or did you have to actually go through litigation? Now my next question is did you file an arbitration or does your car now have a salvage (lemon) title on it? Did you go to trial? I'm just curious what exactly you did to get this all over in a matter of 2 months.

So only non-VTEC engines have this problem? Is yours auto or 5speed?
That is kinda funny the thread about the noise (engine noise)had nothing to do with what you were talking about. I was the one that originally posted that thread and it was in reference to a siezed bearing in the alternator. My alternator had a bearing in it that seized causing a VERY loud noise. Ultimatly the alternator was replaced and the noise went away. So I still have no idea what common problem it is you are having.

I deliver pizzas in my 2001 lx. its a horrible thing to do to my car because i drive pizzas 4 days a week for Imo's pizza in st louis. but anyways, about a week a go my tranny started humming. like the front half of my car was vibrating pretty hard off and on. i try to drive my engine at the lowest possible RPM's to keep from reeming my car. So the humming would start when i was in like any gear accelerating hard at any RPM under 3,000. the vibrating continues sometimes through 1st gear all the way to 5th (*no grinding when the clutch is pushed in). when it starts grinding you can feel the teeth in every gear. so im taking it in next week to get it checked. my car also idles really screwed up to. my car sucks.

I tried every avenue possible. I tried MULTIPLE times to have it fixed. Then I offered to buy a new Accord v6 if they purchased my car back. After they declined I pursued the Best Business Bureau to assist in the lemon law. If you pursue the lemon law in Florida you have to go through the BBB. I went to an actual abitration and represented myself and Honda had a lawyer. The car is now a lemon and I turned it back into Honda. They paid off my loan and gave me a check for the additional expenses they owed.
In Virginia, the lemon law <http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+59.1-207.13> requires that the owner notify the "manufacturer" not the dealer, and that a "repair" be attempted three times. This is sometimes hard to do when the dealer cannot replicate the problem. Pwrful4, please post to the thread how you proved in arbitration what the problem was. Thanks.
You can take it in and whether they do anything they have to write it up. All you have to prove is that you made a reasonable amount of attemps to get the car fixed. After that point then you can file either an arbitration or sure Honda.
