just yesterday i was by islington and rexdale area and i sped up on a straight away to get away from a guy that was tailgating me and i get pulled over a few minutes later by a traffic cop that was hiding on a side street with a radar. this really sucks since i wasn't even supposed to go up that way. i only went that way because i missed the highway exit.
he promptly writes me a ticket for 77km in a 50km zone...i disagree with the cop, my speedo read 62km. the ticket is $130, AND he writes me an additional ticket for not wearing my glasses, which it states on my DL. that ticket is $110. i try to explain to him that i usually only wear my glasses at night because i see fine during the day but he doesn't seem to be too interested.
i already went and applied for a trial date. now i need opinions from people that have experienced the same thing. if i get convicted will my insurance go up? i've never had a ticket since i got my G almost four years ago. what are my chances of getting off on this and what are the procedures of the court when you go for trial?

When you go to court dont call it a "straight away". LOL
Anyway I doubt you'll get anywhere with the glasses if it says you must wear them. If the police officer doesnt show up hopefully you can get the ticket reduced to less than 16 over..(no points and small fine)

what is your prescription??
tell the prosecutor that you dont you have a condition that you only need to wear 'em at night? dont know if that's legitimate. ....... next time, maybe leave a pair of glasses in your car... like one of those 5dollar reading glasses from the pharmacy and leave it in your car. haha
as for the speeding ticket, tell that exact story to the prosecutor... "that a person was tailgating and driving unsafely behind you so you decided to speed up to make a lane change so that car can pass you. Coincidently, an officer was up ahead and radared you." .....as the prosecutor, if he/she maykindly enough to cancel the ticket.
make a first appearance.... see if you can get rid of the tickets before it even gets to trail..... a few of them (prosecutor) are usually nice.... if they believe your story. Look sincerce.
if it doesnt work on the first appearance... see if your story will work in court. I dont know if they document the first appearance though...
good luck

For sure take it to court, same thing happened to me 74 in a 50 zone. It was like 7 in the morning and I was half asleep. I could swear I wasn't going that fast though.
So when i first went into the court room, i went to sign in and the guy asked me if the cop shows up would I plead guilty for a lesser charge. Meaning no points and have to pay a fine, I said okay.
There was a bunch of other people fighting there tickets at the same time, and out of all of them 1 person went up to argue there ticket.
I ended up getting lucky cause the cop didnt show up. I had a feeling she wouldn't show, cause when i got the ticket she said how she didnt like going to court.

FIGHT IT!!! i pay over 600/month insurance for the next 2 years...I got 4 speeding tickets, I learned my lesson the hard way, I never speed, always wear my belt now...no insurance company will take me, bu tthe high-risk ones...so make sure you fight it...good luck
tell them you had your contact lenses in and cuz you were stressed abt the ticket and repercussions of the ticket, forgot to explain to the cop that before (when you got your license) your glasses were for distance and the prescription was minute. and then, they were replaced by lenses and you wear glasses only at night cuz your lenses get dry. mine get too dry sometimes so i wear my glasses when driving but i personally prefer lenses. makes sense to me. just a thought, good luck!

i've ben to court NUFF times...
you getting off on a 22 over .. sorry it wont happen... your best bet is to plee for a lesser charge... say you were going 15 or less... and say you were concentratinf on the road not your speed... accept that you were over the limit buy swear that you felt like it wasnt to fast...
or
you can get those x-copper guys... cause those guys are worth it in the logn run!!
anything less that 15 KM/h or under is 40-50 bucks with no points!!
and GOOD LUCK!!!

pleading gulity to a lesser charge is STILL a conviction. meaning it may still affect your insurance come renewal time.
best option is to get the WHOLE ticket off with NO CONVICTION.

i went to xcopper and they quoted me $350 + taxes to handle my case. i also would have to pay the fines if any.
they said i would have a case with the speeding since i was being tailgated and i sped up to get away from the situation. i have a chance of getting the ticket withdrawn because of that. he also mentioned that since this is my first offence my insurance rate will not go up if i am convicted but said it also depends on which insurance company you are with.
is $402 worth it for just representation?
BTW: if the accusing officer does not show up at court does that mean the ticket/s are dropped and you get off clean? also, on the ticket the officer made a mistake on the year of my car...i drive an '02 and he wrote '05 could this error get my case thrown out?

if the officer does not show up, your ticket is withdrawn.
as for the error of the year of your car.... dont think that is enough... b/c he still got info. about "you" correct.....
but check that up.. im not 100% on that.
as for representation.. imo, it's not worth the money... whatever deal they get... you can get also with the prosecutor.
imo.. take your chances... show up for court, if he shows up, ask if you can request more time to seek more legal advice, you have a right to do so.
if he shows up again next time... then tell the prosecutor your story.. how some guy was tailgating you... and hope he can cut you some slack and a good deal.
or.. HOPE THAT THE TICKET COURT DATE IS SET ONE YEAR AFTER THE OFFENCE DATE.... so then you can fight it on a different case. ---> "your right to a speedy trial"
did he show you the radar? sometimes they just lie about the radar thing. if he got your speed on radar he will show up 100%, if not, he may show up and in that case if you fight it with your argument you will win. If he shows up and has got your speed on radar it will be reduced to a smaller fine and no points but it's still a conviction and will effect your insurance. GOOD LUCK and the X-COP thing is not worth it since they do the same thing.
