Should I be paying taxes on these?

OK I got my koni yellow's in the mail today (UPS). I bought them from another member on this site from the US, not a vendor. And I got charged $120 gst+pst.

Should this **** be tax free since its not new?

not really... i've got charge befor for used parts from the US...

I don't think there should be duty on products made in the US. I also got a $100 brokerge fee. THat's $220! That can't be right.

u can avoid UPS's brokerage fee by clearing the item yourself from customs..

i don't know the full procedure but thats a way around it

doesn't sound right man.....how much did u pay for the konis?...the most u should pay for brokage is about 50 something dollars... and why are u paying tax for used part? how do they even know u brought them and not just ur friend sending u gifts? i brought coilovers that is 850 and only paid 120 total

Yeah the guy gave them to me for $420 US shipped which I thought was a good deal.
And then he marked that the value of them was $600 US on the package. He also told UPS that they were Koni shocks so they probably think I bought them off a company.

if you ship from the states, don't use UPS...
they charge u an arm and a leg for brokerage + customs

there was a thread earlier about shipping to canada....

although it's riskier, USPS will keep your costs at a minimum....

The taxes are easy enough to reconcile:
$600US*1.35(X-rate)*0.15(tax)=120.
That means that his gross up from 420 to 600 cost you about $36 in GST and PST. I can not understand why he would do that, unless he works for the Canadian government.

you say they aint new..

so thats double taxation which is illegal. i assume he had to buy them. meaning he paid tax for the original purchase, and taxed you on the resale. illegal... and he screwed you over when he told ups the cost, you're supposed to say its less to lower the duties charged. sorry to hear this man.

I know it sucks. I'm going to try to get ahold of canada customs to get a refund on the taxes.

And I talked to UPS yesterday and she told me if the seller faxes in confirmation that the value was less than $600, they will refund some of the brokerage fee.

ok so since my wife works at a customs broker, i know how all this ***** works. fisrt off, it does not matter if the product has already been purchased in the us. if you are buying a used product from the us and bringing it into canada, you have to pay gst and pst on the estimated cost of the item. also if the item was not manufactured in a N.A.F.T.A (us,cnd,mx) then you will have to pay duty for it. as for the brokerage fee, the price of $100 probably included both the shipping & handling charges (aprox. $60), as well as the brokerage fee (aprox. $40), and since he ups'd it that means they use their own broker, so you are going to pay a premium brokerage fee compared to doing it yourself. so let this be a lesson to you all**** if the product is used that you are buying, have the seller put a low estimated value of goods on the item, this way you will not pay any GST or PST. Hell i just shipped 2 couches and a 50" tv from Arizona, plus about another $2000 in misc stuff and i only paid $75 in gst and pst, because we put the estimated value at $500.

dude also, your brokerage fee should have nothing to do with the value of you goods. brokerage fee's are a set rate for doing paper work to get the shiite across the border. even if your shipping and handling are include in that fee, which theyshould be, the price should still not be affected because shipping charges are not reflected by the value of goods but rather the weight and distance to be shipped. if you have any ?'s let me know, i may be able to help you.

no, the taxes will not be refunded, he put the value on, and that's what you have to pay. i would go after the seller. if you haven't paid him yet i would hold back about $30 because thats about what he cost you in taxes by upping the price from $420 to $600

UPS told me yesterday that the brokerage fee depends directly on the value.

They have the brokerage rates according to package values posted on their website.

Nope already paid him. He seemed like a good guy tho, I doubt he tried to screw me.

tell them their brokerage is B.S. then, and that every other broker goes by box count for fee's not value of goods. put it this way, whatthey are saying is that, if you pay $0.10 for every dollar the good is worth then if somebodey shipped something valued at $1000 would pay $100 in broker fee's, but on the other hand if somebodey shipped 1000 boxes at $1 value each, and all different items, then they would have to pay the same broker fee, yet the broker is doing 1000 entries for each item, where as if it was one item you would only do one enrty, doesn'y make sense to me.

The funny thing is, I also got my tires from the tire rack yesterday. THey were shipped through UPS as well, and it was a massive package, 84lbs. THere was also duty since the tires were made in japan.

And the total fees only came to $170 cad, way less than the shocks.

Yeah just to confirm:
1. UPS brokerage is by said value of goods
2. It is not illegal to have the tax paid on used goods coming into canada because they have never been taxed in Canada before
3. UPS is rip-off

it doesnt matter if the goods were purchased used, manufactured in USA, whatever. As something coming into Canada, unless the value is less than $30usd, chances are u have to pay duty taxes.

learned your lesson...all the stuffs i bought off ebay or online, they were all shipped by USPS only. If the seller refused to ship with USPS then i wont bother buying from him/her. I heard FedEX is also as horrible as UPS when it comes to broker fees and other ghey charges.

Anyway always tell the seller to mark down the value of the goods, never mark down full retail...etc

As for taxes, you can't really refund it back cuz the government has all sort of excuses to reject your request.

As for UPS, see how lucky u can get and if the seller really fax some prrof that the goods is less than $420USD or you are pretty much stucked at paying them.

Seriously for the price u paid for the used Koni, u could add a little more and get Brand New Koni shocks man

Yeah tell me about it.

iamfob, the shocks were actually new, never installed, so $420 US was initally a really good deal.
