Speeding ticket
well going to work got pulled over going 80 in a 55mph =\ but the police officer wrote on my notice that its was a maximum speed limit of 55 when the sign does not state maximum but it only says speed limit 55mph...... just to let everyone know in cali there are to infractions one is CVC 22350 which is breaking "Speed Limit" and 22349 which is " breaking Maximum Speed Limit" which according to the officer i broke but when i really only broke 22350 because the speed limit sign does not state that 55 mph is the maximum speed limit. what should i do anyone? And 80 in a 55 mph what am i looking at if i am guilty like how much will i be fined? thanks guys

Answer to problem 1, call department of traffic and find out the difference between speed limit, and max speed limit.

I agree about asking them those questions. If the sign really didn't say Maximum Speed Limit, you could take pictures of the street and sign. A friend of mine did that when someone passed him in a NO PASSING ZONE and that someone slaughtered his CRX. If the tickets is written as you breaking the Maximum, it will most likely be more. Hope it works out for you.

Anyways, its nice to see that someone who got a ticket is NOT trying to ***** the rest of us to pay it for him or to try and find a way out of it, takes ***** to admit youve done wrong and just pay up for your mistake. BTW, dont take my post too seriously, its the best way i could answer you without flaming you for not searching, thers lots of post here every week about speeding.
In cali it goes by the number of tickets you have recived. The first one is like $130 second is more like $250, third is like $300 something, not sure on the numbers but I know the first ticket is pretty cheep..fine wise.

But... I hear this a lot when I walk passed the Violations office at City Hall (where I work) while transferring papers/files or something to other departments. Your best bet would be to call the local traffic/violations or law department (of the city you were stopped in; or state).
And please don't call them and have an attitude. So many people talk to the poor workers in the Violations Dept like they were the ones who pulled them over and gave a ticket. The simplest way to avoid a ticket is by not speeding at all.

My only advice to you is to go to court and fight it. Make sure that the cop was in a marked car and in full uniform. Also I hope that you din't admit to the cop that you were going faster than 65 because if you did you lost your case as soon as the the cop states it. (This is what happend to me I told the cop I wasn't going 91 that at MAX I was going 67.) The judge might asked you if you alter your speedometer. Say no to that say that its a new car and there is no reason for you to believe that it was giving you a false reading and that you know that you were going 65 for sure! If you say anything that might lead the judge to think that you alter the readings or your speedometer (like new wheels) you lost your case. Also don't say "my speedometer was reading 65 like you are scare or not sure" CVC doesn't require a car to even be equiped with a speedometer so it won't held up in court. Remmember you were going 65 and 65 only (or below) this is the only way that you can win the case. The judge that I got was a ****. Hope you get a better one.

If you read my first post, i recomended to him what he should do, seeing as he doesnt know where to start, whereas your post just blatantly states the OBVIOUS that he is going to be paying a lot and his insurance will go up. If there is ANYONE here who didnt know that, please let your voice be heard...
Im just getting tired of useless posts that do nothing. This site should have a huge disclaimer on the one page that states.... "BEFORE POSTING QUESTIONS, PLEASE SEARCH" and then provide a huge search button for those who dont know where it is.
I just got my second speeding ticket about a week ago. It was also 80 in a 55 zone. I have not called or anything to see about the fine or if there is a traffic school I can go to. Good luck.
Well here in charlotte, if you get cought going 15 over then you get your licence revoked...I dont know what it is over there but i would assume its higher?? Also Get a lawyer!! HELPS i got one for two tickets he helped out alot......And for US to help you out we need to know your past driving history...tell me that stuff and ill give you a figure
theres no way my ticket will run 300+ dollars wow...... most likely its going to be 150-200 dollars this is only my first speeding ticket and plus i wasnt 30 mph over which is consider wreckless driving which i was not doing. and my friend got the same ticket 80 in 55 on the same road and paid 150 but i am also doing a written trial because i have a nice written statement up about facts of certain laws and no im not writing to say i did not speed i am writting to prove some points and try to get my payment reduced.
A guy i work with used to be a cop, and he told me to ask for the officers log book in court. Because every time they use their radar they have to check and make sure it is reading within specifications and log their readings in a book. Most cops won't keep their log book up to date, because it's such a hassle to do. Usually the judge throws out the ticket, you might have to pay court costs, but that's better than the ticket.

22350 is the "Basic Speed Law", which states No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.
22350 is commonly used to cite people on surface streets and freeways that are not posted at 65mph (such as 55 and 70). You will not find any refrence in 22350 to posted speed limits. The speed limit signs are derrived from a traffic and engineering survey performed on each street by the city.
If your ticket is a radar or laser ticket, then your defense should be pretty easy. In order to admit radar/laser evidence in court, an up-to-date traffic and engineering survey must have been done, and the prosecution must submit a certified copy of the survey in court. That burden is placed upon the prosecution, however, you should call the city hall and get a copy of it to make sure it's up to date.
If they do not submit a traffic survey, or the survey is out of date, then by the letter of the law, that evidence has been obtained by use of a speed trap (CVC 40801) and is inadmissable in court, persuant to CVC 40803. The court cannot find you guilty based on speed trap evidence (CVC 40805).
Also you should also file a request for discovery with the DA and request copies of the front and back of the officer's copy of the citation. The DA is not required to fulfill your request. If he does, you'll be able to prepare better by reading the officer's notes. If he does not, you can move to have your case dismissed because you were unable to properly prepare your case. Make sure to send your request registered mail, and keep a copy of your request so you have proof you sent it.

I got a ticket about 2 years ago for going 52 in a 35 (down the hill from where I live), and I got it thrown out because the officer didn't file it within the appropriate amount of time. Granted, I live up here in washington so our laws may be different, but I'd check into seeing if they have something similar to this. Also as stated earlier, all radar guns have to be calibrated every 6 months or so, and if they're not, you might be able to get it thrown out. Lastly, Up here we can defer one ticket every 7 years, which means we still have to pay the fine, but it doesn't get reported to our insurance. I'd be sure to check out all these options.

2. get a radar/laser jammer. (minimizes chances of getting clocked)
3. get a scanner. (you'll know when they got you so run, exit and hide!)
i never got caught. all those three things help each other in case one fails. and most of all for those stupid air cops, make sure you have a sunroof.

Jammers are highly illegal just about everywhere. Radar detectors usually aren't illegal because they simply receive radar transmissions. Radar jammers transmit radar and that will violate some bigtime FCC regs.
It's not hard for an officer to tell if you're jamming, because he'll get irratic readings when he tries to clock you.
By all means, use whatever techology you can to avoid tickets, but I wouldn't recommend jammers to anyone.
