police just left my house...
ok, so i was driving in the right lane, passing an old Doge Van-(big curb on one side and the Van on other), when the Van swerves into my lane!!! So I slam on my brakes and go for the curb. Now I've got a big scuff mark on my ground effects and my hubcap is all bent up. It's a good thing I didn't have my rims on. Sorry, I just wanted to vent a little.
So my question is... is it worth to file an accident report? If I do, will it make my insurance go up even though it wasn't my fault??
I was a little nervous when the police were looking at my car b/c I don't have a front license plate, leagle headlights, or leagle tint. Oh well. The officer was pretty cool.

It's probably only really worth it for insurance reasons and if you got the plate number of the van.

dont worry about the "legal" headlights

If you file an accident report it will make your insurance go up regardless of who's fault it is. The point is is that you filed an accident meaning that you did get into an accident so it makes you more liable as a driver. Here's the question you should be asking...

1.) Did the guy stop or did you get his/her plates?
2.) Did you file a police report and take pictures of the damage?
3.) How much is your insurance deductable?
For #3, if your estimate is less than the deductable, i say don't even report it because they'll raise your premium even though they didn't have to spend a dime on repairs..
the wheel is easy to replace.. i'm sure if you go to the marketplace you can find someone willing to donate or sell you a stock wheel cheap and the side skirt or front bumper can be repainted fairly cheap...

If its just a scratched ground effect skirt and a messed up hub cap, then you might as well get the skirt fixed and it'll give you an excuse to get rims. The last thing you want is higher insurance. Thats just my opinion though.

Don't file it. Simple as that. It's not worth a higher deductable. It's cheaper to fix the car than to have to pay more for insurance monthly. Trust me. Even if you had to replace it, it'd be cheaper.
I crushed my fender on a pole accidently and it only cost me under $300 to get a new fender and have it painted. Far cheaper than insurance.

I'm not really sure what my deductable is. The police are getting an information report and are getting back w/ me tomorrow so I'll know more then. Thanks for all your help everyone. Have a good night.

Unless the police charges the guy (with a ticket), you will be 100% liable for the accident (involving 1 vehicle).
That means it's your fault (sorry) for dodging him and hitting yourself. Like if you had to swirve out of your lane to dodge a guy who just cut you off, and you hit the car next to you, you are 100% liable even though the guy who cut you off caused the whole thing.
So the bottom line is, you file for insurance if this guy isn't getting charged, your insurance will sky rocket (unless your insurance company has first-time-forgiven, but it's rare since 9-11) and you'll be better off paying for your damages unless it's over $1000~, because your premium will go up, and you'll likely have to pay $300 or so deductable.

. yes file for a report, good for records, wont make a difference on the ensurance unless you are at fault (which i doubt)...police dont talk about whos at fault, their duty is to record everything and make sure you are ok and things are clear.... ensurance does the blaming

The guy did come into my lane w/o signaling - so I would think it would be the other guy to blame, but I'm not sure how that works.
The more I look at it, the less I notice the scuff. I think it was just a little shook up and mad about it last night. I'm not going to file an accident report-it doesn't sound worth it. Plus, I'm not trying to make the guys life miserable. I'll just forget about it and get it fixed on my own.
Next time maybe I won't try to avoid an accident. Maybe I'll get a broken arm or something and be able to get an RSX-S.[IMG]i/expressions/face-icon-small-wink.gif[/IMG] j/k
