Got a Speeding Ticket Need Advice.
Here is what happened.
I left my gf house at 4:10PM it takes about 5 minutes to get to the highway from there. So I'm stuck behind a big semi-truck right before I start to merge in to the highway. As you know, they don't pick-up speed so fast so i'm going about 35mph trying to merge in to the highway so as soon as I could merge in I do and start to speed-up; then in a few seconds (one or two) I had to swirve to avoid hitting a pot-hole when i do that i also notice a white Camaro, Yes a CHP, so I quickly look at my speed which was about 69 on a 65 mph. This all happend in less than a 1/4 mile, from where I merge to where I saw the Camaro. So i'm like no big deal I'm only 4mph above. I keep driving at the same speed and about half a mile away he stops me. He then tells me that he stoped me cause I was taking the turn too fast, that he had finished given a ticket when he noticed me passing traffic really fast and that I had hit the brakes ALMOST LOST CONTROL of my car, He then decided to hit me with his radar gun and gets me at 91mph. So I told him "Honestly, sir if I was speeding the most I could have been doing is 70mph. I had just merged into the highway and passing the slower truck." He then said "No, when you passed me and when I got behind you were going at 69. You where doing 91 back there. I'll tell you what, I say that you were going 90mph and you say that you were going 70mph so I'll just average the speeds to 80mph." at this time i'm thinking wtf. what kind of way is that of giving some one a ticket buy just guessing. I didn't have time to say anything more cause he was already writting a ticket.
This would be my 2nd ticket in a bit over one year. The first one I did deserve and didn't complained about it I just went and paid my fine. But this one is ridiculous. I'm definitly going to fight this one because i know that there is no way that I could have been going over 91 in less than a 1/4 mile. If that is possible then I have the fastes stock civic around. Also he said that I was going really fast and when i saw him that i hit my brakes really hard and almost lost control of my car then he hits me with radar and its 91mph. So that means that for me to almost lose control i had to be going well over 100mph. Can you guys help me in any way? I would really appreciate it.
How likely is it that the Highway Patrol Officer will show up for court?

Depends where you live, but around here it's not very common that they show up. Unfortunately, they did show up when I went to court.
edit: At least appeal it, you might get lucky and have it nolled (thrown out). If not you can talk to the prosecutor and possibly get a reduction of the fine and fewer points.

usually the highway patrol never really shows up. because in my am. gov. class we went to a fieldtrip before graduation to like to 2 different court houses. and as we were listening to the cases, they were mostly speeding tickets hehe. some were there to fight the ticket but the highway patrol never showed up. from what i saw when they call your case and if the chp isnt there (sometimes waits 3-5 mins) and chp dont show up.. judge gets pissed, tells you not to do it again and tells you to get the hell out hehe...
this was at santa ana and westminster.

If the CHP doesn't show up i'm off the hoock eassily. But i'm still thinking of going to the Law Library this Tuesday and doing some research to konw what the CHP has to prove at court.

Well, I am the speeding ticket king. I have 2 exhibition of speed tickets which is anything over 100mph plus 3 other speeding tickets. I can tell you on thing the last exhibition of speed ticket I got I went to court I told the cop the day I got the ticket I was doing about 90mph he gave me a ticket for 135mph, so we went to court he showed up. By the way they pay them to show up so 9-10 times they show. I went to the judge with proof that in that distance at me doing 135mph and a cop car only being able to do 125mph he could have never caught me. This professor at the UC figured out al the distance, times speed time for him to get up to speed and everything. The final speed that he could have caught me was, 87mph. That's about what I told the cop so Im think I am going to get off right me and the judge and cop talked for almost an hour on this so after all the proof, talking back and fourth the judge asked if we were both done we said yes he then made his decision. I feel that you were traveling at speeds of over 135mph and find you guilty. So is their a war to prove him wrong? No.
Here are some tips to make him wrong. He used a radar gun? Was he moving? they are not accurate if they are moving. When was the gun calibrated? call chp and ask that the officer brings the calibration sheet for both the car and the gun. If he doesn't it will be dismissed. EManEX, i'll tell ya as much as i know....I've gotten 3 tickets, so i know the drill...lol. Well what i suspect happened, is the officer was using a moving radar device. It subtracts from the combined speed the speed of the officer and gets yours as a result. Now i recently purchased a book written by a cop about traffic tickets. He states that the biggest problem with moving radar is false readouts, and the second biggest problem with moving radar is poorly trained or unqualified operators. Now if thats the case, it depends if the camaro was going the same direction as you, or coming from the opposite direction on the interstate. If he was traveling the opposite direction at high speed, the radar doesn't work many times. If he was going the same direction, it could give a false readout based on the truck (a huge piece of metal) near you. the radar might sense the truck as a stationary object and not compute the combined speeds correctly.
ok here's the summary of the section that applies most to you...and you can use it to your advantage if you represent yourself in court, or hire a lawyer (mine was 100 bucks)....you still spend money but mine doesn't go on my record, and the 100 bucks is probably lower than the ticket cost. ok...from the book---the moving radar uses two beams, A and B, the job of beam B is to spread out and hit stationary objects, trees, signs, and such......then it bounces back and determines the speed of the police car. Beam A hits you and measures the closing speed of the cop and of you, which is a 'combined speed' Then it subtracts the speed of the officer, beam B, to get the 'violator' speed. Now if the beam B that was supposed to hit stationary objects hit the huge truck instead of the tree of sign the truck was blocking, it would be a false readout because the truck isn't stationary. That will make the combined speed really high, and when the computer subtracts the lower number of the cop speed from the high *** false readout "combined speed"...it tells the cop you're hauling ***. Chances are he didn't bet on you knowing that, but now you do....so have fun and fight it! Also check your ticket to make sure ALL the info is correct, if not, thats another point to add to the first one.
