I have a question for him too. A friend was doing 90mph and was pulled over by a cop. However, the cop did not have a speed radar (?) and wrote him down for doing "100mph + ". Can he take it to court and fight?

Ok best case scenario.... The prosecutor lets me slide on the points and just makes me pay a bigger fine ... will my insurance still go up even though i didnt get no points?

As for the other matter, if you have a clean record, you simply bargain with the prosecutor. You can probably arrange some sort of no points/fine situation.

WRONG. Please do not give advice that is incorrect. Every state has a basic speed law. This allows an officer to use his or her powers of observation to estimate how fast a car is going. While I am well versed in the laws of New York State, I assure you that in all fifty states an officer is not required to use a timing device (IE--radar). So, no, you're friend can not get out of that ticket easily; the cop wouldn't have wasted the paper if he couldn't write it legally.

uhh, this is his 4th ticket in 1 year... Definetely not good. Thank you QCKSilver
I dont think it matters if the officer had a radar gun or not. I was given a ticket while racing a Z28. He didnt radar me, but he was geting the Z. I asked the officer what I was doing, and he said he just estimated it from what the other car was doing. It didnt help at all that it was in a white cobra with black stripes at all.

Well, he's in trouble then as far as his future license history goes.
To address other questions:
*Being nice to the officer: It's expected that you act civil and have some basic manners when dealing with the officer. This means not using profanity, insulting the officer, etc. Depending on the offense, you still may get the summons, but do keep in mind that what you say and do can and will be used against you in a court of law. Officers will note if someone was belligerent, irate, etc., and will often forward this info to the DAs.
*That is correct...radar guns are not required to summons a speeder.
Damnit he always beats me... but yeah pounds you are very wrong I dont have to get you on radar... actually (funny story) just last week I stoped this chick for doing 17 over and when I advised her is was going to write her a ticket she asked to see my radar I advised her that I didnt have to show nor would I show her, so this chick jumps out of her and tries to go back and look in my unit at the radar, lets just say she didnt make it that far and she still got the ticket.... oh and yes on the ? "does it work if you are nice" ... I have been trying to tell people this but nobody gets it.... I dont care if you were going 100 in a 35 if I can tell that you were sorry you got caught and you knew your an idiot for going that fast and say yes sir or no sir then I usually wont write tickets unless the person is an *** or I gotta meet my quota for the month.... ha ha just playing on the last part
Yeah, another good point...I don't know where people get off thinking the officer is required to show their radar to you. That's completely false. It's not good for officer safety to let a subject out of the car and then to the officer's unit to see a radar unit.
As far as someone jumping out of the car during a stop...good way to have a gun pointed at you...as Carbon said, she didn't make it back to the patrol car. .

Oh yeah I was ready to drawn down when she opened her door but when I saw she didnt have anything I just backed up and told her to get back in her car and when she tried to push me out of the way is when I just did a simple arm bar and told her if she ever touched me again I would well I cant really type what I said to her but I let her up and she got back in her car and signed on the X and I let her go after that oh and she was white to say it wasnt a racist thing for all those cop haters out there

and while we are on the subject... Does anything happen if a cop pulls me over and i have a radar detector? I live in California.
Just forward everything she said/did to the DA in charge of her summons so that it can be used against her, as allowed by law. People need to learn how to conduct themselves during traffic stops.
As 02Carbon said, quotas are unlawful, and I believe were found to be unconstitutional.
I believe radar detectors are only unlawful in Virginia and DC.

This goes along witht the whole radar detector/jammer...I heard that you can't get off with a warning if you have a radar detector....don't know if that's true....Also, how would you guys know (QCKSILVR & 02CarbonCivic) if someone had a radar jammer when they pass you?
That's just the individual officer. A lot of officers don't like to see the radar detector on your dash because it means you're speeding regularly, so there's a good chance they'll write you.
As far as radar jammers, the newer guns are able to pick up and let the operator know if it is being interfered with.
