OH MAN!!
Well guys, I just totalled my car. how great is that?! well anyways some [IMG]i/expressions/moon.gif[/IMG] didn't have any brake lights and was stopped to turn with no turn signal, and well, i couldn't stop fast enough. In ohio, if you rear end someone its your fault, but hey Quikslvr do I have a case to fight it? my g/f was in the car, so she was a witness, so i have any case? or should i just bend over and take the 6 week license suspension?

still your fault.. driving at unsafe speed.. ur lucky u didn't get a ticket..... cuz i did when i rear ended some 1..... and u should be able to stop under any circumstances... sorry can't help u....75% ur fault=100% your fault

Wait, was it at night? No brake lights? That's illegal. He would be at fault if this was the case. I had an accident similiar to yours. Don't take it up the *** man, fight it!
No, it doesn't really matter. The ONLY way to get out of a rear-ender is if you can prove that the driver was traveling in reverse and hit you. There is NO WAY out of a rear ender. I summons for no brake lights; it's dangerous (it's not a big ticket; gets automaticially dismissed if it is fixed w/i 10 days of me writing it up).

UNSAFE SPEED, yuor an idiot, i was going 40 in a 50, it was during the day, and i couldn't see his lights, nor any turn signal, its like, no one's fault, thats why its called an accident

obviously u haven't known this... speed is determine by traffic and road condition.. posted speed limit don't mean u have to follow that ...so ur saying that i can drive at 40mph in a 40mph when the road is in rush hour?????????????????????????????????????????????? then when i hit sum 1.. its not my fault????????????
As a police officer, I don't consider 50 in a 40 unsafe. In fact, if I was running RADAR, I probably would have the unit set so it wouldn't even grab someone going 50. I usually give a 20 MPH leeway, wheras most cops give a 12 MPH leeway. The guy that you hit had the responsibility to make sure that all of his equipment was working before driving his car, but as we all know, no one really does that. While I refer to most 'accidents' as 'crashes' because they are preventable, I am not quite sure how your situation could have been prevented. If fault has to be assigned, I really wouldn't be able to say it was your fault. When I drive, I always have at least two "ways out"--it's a defensive driving tactic that was taught to me in the police academy. You develop the ability to predict what a motorist is going to do and have a way out to avoid an accident. In any event, I don't think you were traveling at unsafe speed or if your accident could have been prevented. I was rear ended once and the person who hit me was held accountable 100%; but the important thing is that you are not injured.

You do make a good point. There is an offense called "not traveling at a safe speed for existing road conditions." So, in a rain storm, snowing, etc., I could summons someone for traveling the speed limit. However, if the road conditions are fine, 50 in a 40 would not catch my attention.

well, seeing as how i slowed down enough that the air bags didn't go off, i wouldn't call it that unsafe, anyways, why would be going FASTER of been unsafe, hmm, think about it, a residential road that is 50, that shouldn't even BE 50. going 40 is actually what most people do! do you think with my story the judge will be more lenient?

QCKSILVR, if my car is parked and i have blacked out taillights and my car gets hit, would i still get money for it? i'm asking because this happened to my first car, the taillights were stock but i want to black it out, only reason i'm not is for this reason.
I also rear ended someone who slammed on their brakes in frong of me because he almost rear ended the person in front of him,. like you I was slowing down but not fast enough and I hit him it was still all my fault. My airbags did not go off either.
You were going that slow and it totalled your car? Or it just messed up your car... I don't know what that says about your airbags not going off though, because my mom hit a deer in my civic (almost head-on, it hit at the left corner front bumper) going about 65 and the airbags didn't go off..
