98 civic ex not shifting into fourth gear

I just got a 98 civic ex from a friend that was ran into the ground. I got the car for a steal but have done a lot of work to it. After getting it up and running, pretty good i might add, it sems to not shift into 4th. It also seems to shift faily slowly into the other gears. Its got 230k miles on it so im assuming a flush is out of the question. The engine light is on too, going to check that tomorrow. Any ideas on why it wont go into 4th?

Get the codes read for a start and that will get you pointed in the right direction hopefully. What condition is the fluid in? Clean, dirty, burnt, foamy?
