Do I need to use this gasket #17 (http://www.hondaautomotiveparts.com/auto/jsp/mws/prddisplay.jsp?inputstate=5&catcgry1=Civic&catcgry2=2001&catcgry3=2DR+EX&catcgry4=KA5MT&catcgry5=EXHAUST+PIPE) when i put on my new cat back or can I throw it away.

yeah use it. it will help prevent exhaust gas from leaking. Just so you know it sometimes it will make a whistling if the gas is leaking, sometimes not. But its a good idea cause you don't want it to leak.
