Axle broke on my 02 Civic SI

Rep Power: 0 Axle broke on my 02 Civic SI
The right Axle broke on my 02 Civic SI. Just driving down the road it came apart, the tire folded out and the right side of the car hit the road. Folding in the front bumper as it slid down the road till I could stop. A lot of damage underneath and the quarter panel is dented it also. Has anyone seen this before? The car is under warranty but they are saying it has been wreaked and that is the reason the axle is broke. I am saying the axle broke and that is why the front of the car is messed up. Anyone know what I can/ have to do to get Honda to warranty is?

Rep Power: 307 do you have any modifications that would damage the axles? they will get you for suspension mods and heavy engine/tranny mods.

Rep Power: 347 Man... go back to the dealership and tell them to fix that **** for free! They don't want to warranty your car so they're trying to blame it on you.
Put up a fight man... if this really wasn't your fault then there should be no reason for you to pay for the repair.

Rep Power: 0 wow, I've seen a lot of Hondas with that same problem (but this is the 1st 7thGen). If you don't have any suspension upgrades, swap, turbo or Limitted Slip Differential they HAVE to pay the whole problem. You should call directly to American Honda instead of your dealership and ask them for some help. If it doesn't help just sue American Honda because of your specific situation. Many people will tell you that is stupid to sue Honda, but I know a few people that have done so because of that specific situation and they have won.
You REALLY need a police report of what happened to the car too.

No modifications, stock, 30K mileage. The only thing modified is a new air intake. A police officer responded to the scene and called the tow truck we are trying to track him down.

Rep Power: 299 get ahold of the cop for a signed statement, take that to the dealer. If they still don't want to help then get a lawyer. You should not have to pay for anything/.

Rep Power: 0 I agree with what the one poster said- call Honda of America directly. Your dealership will probably try to stonewall you.
Maybe mention to Honda you were almost killed. Make 'em wet their pants a little.

Ok there was a few mods to this car. I forgot about but I don't see it breaking a axel,
Mod 1 was new air-intake It was on the car when we bought it.
Mod 2 was torsion bar across the eng compartment near the windshield. It was on the car when we bought it.
Mod 3 was the break calipers are painted red. It was on the car when we bought it.
I talked to the dealer today and they are saying it has be modified. But before I bought the car I took the car up to a Honda dealer and asked a service guy to come out and look at the mods and asked if it would void the warranty, He said “no” of course I did not get it in writing, but now wish I had.
They are also saying it looks like it has been lowered, but I know it has not. I guess since it is setting on the ground with no axal to hold it up it would look like that.
