ot:McDonalds!! What to do???
I went through McDonalds drive thru last night at 2:30am....I was not drunk!! The drive thru lane is the worst so i went around through the parking lot and got in the drive thru line the other way. As i drove through the parking lot what looked like gravel wasnt and it was actually a big pothole...It was like 2 ft wide and like 1/2 a ft deep. i swear if u put a basketball in the hole you wouldnt be able to see it. Needless to say my car smacked down hard in it. No damage to my car but there are 2 gouges in my back bumper underneath. The pot HOLE wasnt marked and doesnt even look like a pothole... Do u think i can complain to McDOnalds and tell them that the scratches are from driving through the pothole???

i would seriously complain and i would try and make them get me a new back bumper
it's good to hear that you didn't *** ne thing else up though....

talk to the manager see what he says. if the matter does not settle, file a small claims and take it to court. becuase this is clearly neglegence that mc donalds could avoid. i would take pics of t he pot hole, tkae pics of the damage... then seriously take this to court.
Complain, you'll have no case sueing them because you are travelling in PRIVATE PROPERTY. Now on public roads, the public works are suppose to mark them, but in this scenerior, just bug the manager.

but anyway, try complaining first.
Actually the sidewalk is not yours, its government property. Its their responsibility to get it safe... theres no law on making sure private property are safe, its like saying that you must salt your driveway so that someone can walk through it.

no, but let's say a person slips and falls in front of your house or own ur driveway (private property)
i heard they can sue you...so best to buy home insurance!!

its called criminal negligence.... yes if someone slips in front of ur house they can sue you..
"public place" means where public has access to..
like a building it may be owned by a private company it is still called "public" ...cause public has access.......
go check the criminal code........
hopefully my tuition money paid off n i learnt something

but also for stairs ... if you have handle bar on the side and the person slips ... he can't sue you as well ...

you might wanna charge them for trespassing..

my driveway doesnt have sidewalk tho ...

Sidewalk - You sue the government. You do not own the sidewalk, that is why it is cheaper to have sidewalk on your side of property. Ya I agree, no sidewalks kickass, easy parking (well not in my case, I must reverse park and park right right at the edge of the corner, geeze)
I don't think u're going to sue mcdonalds. Most likely you gotta check who's property it was. McDonalds or the owner of the mall/plaza.
But go to McDonalds manager so he can note the problem.
If you got alot of time on your hand. Go to small claims court.
You'll most likely win. BUT the defendant can also argue that your car was too low etc etc. lol

you can sue someon if you pk on their dirve way or path way to their door. but then u can be sued for tresspassing (like stw said) ...
you can sue mcdaees for the pot hole. they may counterclaim and say your car is lowered and stuff .. but that's not likely going to have an effect. so i say u sue like a bitch!!!

HAHHAHA ... that'd be funny. ya, as i said earlier ... talk to the manager first.
hahha ... and yes, i know you can walk on the sidewalks!! ... it's not like i just got off the boat from china you know ??!.... haha ... i was talking about walk way. as in the walk way from your drive way to your front door.
