YES, THAT'S APPARENTLY WHAT'S GOING ON.

My mom was driving on the highway to go pick up my sister from class at a community college. Someone's in the left lane, doing 50-55, and driving erratically. After a few cars pass the two of them (my mom, and the erratic driver) she pulls into the right lane, and proceeds to pass. Once she is almost passed, the erratic driver decides to pull over too, clipping her rear bumper. (just left a skid mark of their bumper on the side).

She gets off on the next exit, and proceeds to turn left, under the highway. The person who hit her, follows her. (Mind you, the highway isn't lit up that bright, as we all know, seeing how this isn't exactly the city). she then pulls into the left turn lane to go into the community college, while the person who hit her, goes straight and takes off.

Now, she wasn't about to pull over in the darkness, after being hit by someone driving erratically. The community college is the most well lit area around there, and most populated.

The highway patrol came to our house (2 CARS, mind ya.) they seemed a little surprised that she was the one who was hit. (i'm guessing that they haven't talked to the other person face to face yet). All they kept saying to her was that she has to pull over when there is an accident such as this.

make any sense?

CLIFFNOTES: My mom passes someone driving erratically. The erratic driver hits her. she pulls off the highway into a well lit area. the erratic driver passes her at a light. She's at fault, aparently for not stopping in the dark!?!

i wouldn't have stopped either, because if he/she was that bad of a driver you'll never know what they would do if she would have confronted them about it especially if she was alone, as for the HP they are dumbass for assuming it was her fault if she didn't stop after reading sounds like the other driver didn't want to stop either.

yeah man, she had every right to pull into the college,...never know who youre dealing with now-days. and even police should know that if you want you can wait a lil bit and pull over somewhere that you feel safer.

Unfortunatly it is concidered a form of hit and run. She legally does have to stop to swap info and check the situation out. What she should have done is contact the police department at the time of the accident, and informed them of the situation, ie not feeling safe and wanting to pull over at a more illuminated location. She does have that right, but with her just leaving it could be classified as fleaing the scene of the crime.

she oviously feared for her phisical safty and i would have done the same thing by finding a lit place if a person was driving crazy.

did she at least contact the police or report the scene after she felt "safe" to do so?

if no, then thats the problem there probably confronting you about. i can understand about pulling over where its dark and not many ppl around, but your mother should've at least signaled the driver who hit her van somehow. the reason why it can be serious is because none of you drivers can know if other things happened at the same scene (IE: car behind you was tailgated because he or she was breaking to avoid you guys, tail light piece fell off and flung into someones face, etc lol). from now on, tell her mom to ALWAYS report the police if shes not at fault. if shes not at fault, its up to her so she can take advantage
