I know laws are skewed in different states, but common sense would indicate that unless a cop is in the rearview with their lights/siren going, I don't have to pull over. Now, maybe I'm wrong...but to someone not in law enforcement like myself, I wouldn't "give myself up".
I wouldn't call it evading or fleeing the police...since those terms usually connotate that the police had engaged him already. I would say he was trying to hide. And unless the cop was already in pursuit (lights/sirens), there is no law regarding what he did...to my knowledge. I mean, if he didn't see the cop take a U-turn...he probably would have been pulled over much earlier.

Ok just to get it straight. If I'm driving to my house cause I forgot some papers and a cop is behind me with out the lights on. I just pull over get out of the car and run towards the back of the house without entering the house. That is fleeing the cop? Autocross Junky

Now that just dosn't make sense. If the officer made no indication of pusuit then how is parking, geting out of your car and walking away fleeing? For all the person knows, the Officer may just have been going the same way him/her. if the officer made his intent Known then yes by doing so I would consider it Fleeing, but if not, then I would fight the charge.

I think you are taking what I said the wrong way. In a traffic situation, where the cop did not activate the lights/siren, how would you know to pull over. From what I read, he pulled into a parking lot before the cop could do that. Is that against the law? Seems to me that if the cop wanted to get him badly enough he would kicked on the flashers earlier and got him.
I think the poster was aware enough that a cop spotted him and he took evasive action before the officer could pull him over traditionally. A court would not call that "evading".
I don't pull over and wait for a cop to ticket me cause I'm speeding. I only pull over if he's behind with lights/sirens...or a speed trap where they wave you over. Either way, from what the poster explained, the cop never showed that he was making a traffic stop until he found him on the side street.
The police can't be that vague when dealing with the general population. Myself, I only respond to police when there in my rearview flashing, waving me over, or when I call them. Otherwise, I don't hang around them too often.

Injencivic,
So in a situation like I explained would that be consider fleeing? Not to flame you but you just whent around the issue and stated that if ones resist then thats consider fleeing. I thought that was just resisting arrest? do you charge you with two stuff?
Once again not flaming you just want to see it from a cop possition.

Ok now I'm all pissed off because you think you are some all knowing cop! I was not evading. Evading is only constituted when the officer is already in persuit of you WITH LIGHTs AND OR SIRENS! He did NOT have his lights or sirens on when I had pulled into the parking lot or when I saw him drive by me. POLICE OFFICERS CANNOT MAKE A MOVING TRAFFIC STOP WITHOUT LIGHTS AND OR SIRENS WHILE THEY ARE IN THEIR VEHICLES! The only time he DID use his lights is AFTER he blew through a stop sign WITHOUT them and pulled behind me. As soon as he pulled the third U turn in the middle of the road and got behind me he turned them on. That is when I pulled over. By law, he was NOT in persuit of me until he had gotten behind me and turned his lights on. There is NO such thing as an officer civillian vehicle persuit without lights and or sirens. This IS harassment by far! Oh and one more thing the ride height of my vehicle is 110% legal. I had measured it the following day and it ended up being a full inch over the required height. I don't need some rookie cop telling me how I was wrong. I took criminal justice for 3 years too pal.

One last thing. If I WAS evading he WOULD have arrested me and impounded my car. This guy is the king of all a$$hole cops and IS known for it even in his own department. Personally, I know a number of officers that work in the same department and feel the same way about him.
