Okay so if everyone doesn't already know I was a victem this past week of a hit an run, ruining my brand new paint job.

After speaking to a few police officers it turns out even if you have the description of someones car AND their plates not much can be done with regards to a conviction of hit and run (called failing to remain under the law) thus meaning no compensation and minimal chances in court.

So basically if your ever involved in a hit and run make SURE you see the driver otherwise you stand "little to no chance" as quoted by the officer.

so why did I start this thread? Well let me give you a background as to the legalities of hit and runs in ontario.

The charge of Failing To Remain at the Scene of an Accident can be layed two ways.

1. Under the Ontario Criminal Code
2. Under the Highway Traffic Act

In situations like mine where there is arguably a chance that perhaps they didnt notice (despite my car alarm going off) it is usually against the Highway Traffic Act much like a speeding ticket and is not that serious of a charge. Likly just a fine.

However heres where it gets intresting, say your in a mall and some dude smashes your car. You think dammit its 50/50 liability I just got to sucker it up. Well not so fast, MAKE SURE YOU TRY AND EXCHANGE INFORMATION, including drivers licenses. If they refuse or simply drive away they can be deemed to be failing to remain at the scene of an accident.

Heres the twist, Parking lots are NOT highways. Therefore the Highway Traffic Act does NOT apply. Making a Criminal Charge of failing to remain at the scene the defult if you have his plates and a description of the vechile, but you must identify the driver even if the car is only regestered and driven by 1 person. I was told this by a cop who works in traffic control when hes not on duty (works at a company I work at stopping traffic and such) and his explanation seems logical. All city streets are highways just as a side note.

So there you go, private property is the only time where you may acually want a hit and run!

tham sucks, my moms car hot dented at the mall, well huge ding (i think thats what u call it) cant do anything about it, we werent there when it happened didnt see who, if your damage is really bad, the only thing u can do is, probaly get a secruity take pictures and write it down, and decide to call insurance or not

I unfortunately had the same experience as you with a hit and run driver. Last year some dumbass in an M3 scraped my rear bumper and took off. I got his plate number from a witness, but by the time the hit and run squad officer (which are really understaffed from what I was told by several police sources) went to see the guy (at least month and half later) there was no visible damage on the other guy's car and he disputed being involved in any accident, so nothing ever came out of it. In the end I ended up paying for the repair myself since it wasn't worth filing an insurance claim (ended up costing me about $300 to repaint the bumper).

some guy did a hit and run to some other guy at dixon and martin grove last night

my dad was rightn ext to him and almost got hit too

luckily the guy that ran had a shitbox and the licence plate fell off his car LOL
