THE CRAZIEST **** HAPPEN YESTERDAY!!!

i was driving from work to home down a one way in manhattan. doing about 15mph and out of no were a kid jumps out to the street and in between two cars chaseing a baseball.. i wasint going fast but i didint have time to stop, though i really wish i did. turns out the kid is 9 years old and didint bother looking out for oncoming cars i hit the kid and he rolled over .. every one gather around to see if he was alright and it turns out he was in shock but alright, what a way to end my day... thank god i was going slow because if i was going fast .. i would probably have to ad murder to my achievements in life especially of a little kid...and what upsets me is that im a 21m trying to do good **** and this gotta go and happen were the fack are the parents at, smacking there kids around and telling them not to dare cross the busy streets of the city....if i would of bin some crazy taxi driver with a tank for a lincoln town car speeding down that one waylike they usually do that fackin kid would of bin dead right now.. that **** pisses me of...now my hood got dents on it, bumper got facked up paint and my passenger headlight if broken. and the funny part about it is that i gotta drop 500 dollars in insurance deductable.. for something that aint my fault(fackin parents now a days!!!).... aint that a biiiiiitch!!!! i didint learn anythng from this cause i was doing everything right.... but for every one that likes to speed down every block think about wat your doing man cause you dont wanna have this shiiiit happen to you ..it aint worth it .. personally i save the speeding bit for the highway or for the super dead streets of ny and nj that fill up with illeagal street racing, thats that . peace, be safe thanks for reading, your opinions are welcome

that's some scary stuff man. its one thing to hit a cat or dog, but a little kid. I would be traumatized. glad to hear that he is ok. sorry you have to pay for repairs. that really sucks.

dang man, that sucks. Sorry to hear that. I guy I know hit a kid that pulles out right infront of him on a bike, it wasnt that guys fault but he killed the kid. He hasnt been the same sense. Glad to hear the kid is ok though.

Wont the kids parents give you the cash to pay for your car?. I know I would if it was my kid. But I guess there are just @ss holes out there who dont care that you almost killed their kid and because you were a good driver you didnt. Sorry to hear it though man.

just one comment: u were at the right place at the wrong time. seconds later or earlier, u probably wouldn't have hit the kid. know what i'm sayin? if u were going a bit faster or slower u would have passed that spot before the kid ran to the street or u would have been a car behind during the accident. just my 2 cents. glad the kid is alright and glad that didnt turn out to be a fatal one

A pedestrian has the ultimate right of way, especially in New York State. The New York State Vehicle and Traffic code is worded in a way that if a person in a car strikes a pedestrian, the registered owner and the operator can be held responsible. About 70% of the time when I respond to a pedestrian accident involving an auto, I have to at least issue a summons to the operator of the vehicle for failing to yield to a pedestrian; of course there are exceptions, but it is very rare--if you hit a pedestrian, you are pretty much at fault no matter what the circumstances were.

It's unfortunate what happened to your car, however, the situation could be far worse.

See- that's what it not right with some laws. It obviously wasn't his fault in the least bit, but he could get fined or even thrown in jail. That seems wrong to me about laws that make no sense, and put blame on the innocent.

If you ask me, the person operating the car has a greater responsibility than the pedestrian. A good defensive driver anticipates that a pedestrian could come out from between parked cars (or any other obscured area) at any time. The pedestrian should not have to be more responsible than motorists.

Damn dude, that sux about your car - sorry man. But at least nobody was seriously hurt.
This should serve as a reminder to the rest of us to remember to be extra careful when we get behind the wheel. I know that I'm probably the world's worst driver, but I'm working on improving that.

I'm not saying it was your fault man, just that we all need to be extra careful - so we don't kill anyone, and so our rides don't get body-sized dents in the hood!!

qcksilver i under stand what your saying but im 21 and have never had an accident since i got my license at the age of seventeen, im always alert and can honestly say that if you were at te same place at the same time you just dont have time to react.. if your puting me in that 70% that is at fault ...you should've been involved in an accident to make that decision .. in other words you've probably never hit a pedestrian in your years of driving, But you can't even begin to say it was my fault you need to experiance it yourself before you make judgement... no movie or class can prepare you for something that is bound to happen butthat class may help you better handle the situation after it happen......if i had at least a cars worth of space this would of never happen...qcksilver if you had your own son would you let him runs across the street esspecially at the age of ten in between a van and a car were oncoming traffic can't possibly see a ten year old jump out, i wouldint , i think thats why new york has parks and playgrounds... but either way i didint recieve any summons ..why??, because i fell in that 30% catagory.. hey man, here in CA, that situation, it would have been the kid's fault...

my traffic school instructor told a story simliar to yours.. but the kid was on a bike, and he was going AGAINST traffic... he was going down a hill too fast, lost control, and my instrutor minding his own bussiness got hit... kid was fine besides being shocked and got his biked screwed up...

long story short, kids parent called my instructor... and they asked if he's gonna pay for the bike... he was like, "I feel bad about hitting ur kid and all, but under the law, it was his fault... now, what are you going to do about my messed up bumper and fender?"

still. sucks man. I know how you feel, its not totally your fault... good thing you were driving slow.. did the kid came out so fast that you didn't have time to react to it?

well, at least you didn't kill anyone man. keep driving safe dude...

this is a good example people, where you shouldn't speed down residential area.. good thing our man here was going much slower below the speed limit...

I GOTTA FEELING THERE GONNA SUE MY ****... even though the kid looked alright some people just need money .... i feel sorry for the kid and im still shocked about it .. but not once am i going to think its my fault... that kid shouldint of bin on the streets... if i had more time i would of avoided hitting him by smashing into another car this is worse..

I haven't had years of experience of driving. I'm 23 and have been driving since I was 16, I consider myself a very good and cautions driver. I have been rear ended in traffic once, that was my only accident. Granted, I was re-taught how to drive a car in police academy and I can, for the most part, predict what people will do and can avoid accidents by performing maneuvers that the average person probably doesn't know. I can't expect everyone to know how to do that.

You won't get sued; if the person tried to sue you it would probably get bounced before you even saw the inside of a court room, or better yet, your insurance company would get the person to back off and drop it. The kid is not responsible for what happened to your car for a variety of reasons. One, he was the pedestrian. Two, a child is not is not responsible for his or her torts in the State of New York (a tort being a civil wrong). Three, given the totality of circumstances, you probably handled the situation as best as possible and no party is entitled to anything. The fact that you say you were driving 15 mph and not going fast does show that you were exercising some degree of caution and driving defensively.

well let's hope they're nice. I rear ended a woman at about 4 mph and she sued me for $40,000. My brother got T-Boned and somehow the guy is sueing my family for $100,000 and it's pending right now so we don't know what's going on with it. If u were me and u had my kind of luck, u would get absolutely


by people who ive had experiences with and it's rediculous. i wish u the best

Typical cops. Always looking for an excuse to write a ticket. Quicksilver, you are wrong about some things. The driver of the car will not be ticketed if the pedestrian enters a roadway from an area that is blind to the driver unless the cop is a *****. The driver of the car in this situation can sue the pedestrian if they are over 18 or sue the parents if they are under 18. There are many cases I have heard of in this area where this has happened. New York City may be different because some of the cops there play by their own rules. Remember Hose2k1, cops are not lawyers. Never take legal advice from them.

The condescending fashion in which your comments are stated leave much to be said about your personality. I do take issue with you in your belief that I am wrong. If you read my post closely about the summonsing regarding pedestrian accidents, I had remarked that most of the time a summons will be issued. From this, one can conclude that there exists a chance that a summons will not be issued. Please do not tell me when I may or may not issue a summons. I will issue a summons where I have reasonable suspicion to believe that an offense of the New York State VTL has occured. Second, anyone has the right to sue anyone they want to. It doesn't even require an attorney to file suit; you simply walk into the court clerk's office and file a form. The court will even serve the defendant for you in my county. Whether or not it will actually get to court and scheduled for a trial is a whole other ball game. Based upon what has been presented by Hose2k1, I do not find that he can be held responsible for anything, however, anyone can sue anyone they want to.

I am not with the NYPD, but rather a member of a department that neighbors it. I don't appreciate your implication that the NYPD "plays by it's own rules," as most NYPD officers are good people that follow standard operating procedure.

I never said I was a lawyer, however, officers have more training in the law than do most civilians. I am probably going to move on to attend law school sometime in the near future as I have many family members who are either judges or attorneys. Any member on this board will be glad to inform you that my legal advise has been helpful.

I apologize if I come off as arrogant or condescending, but I'm not going to stand by and let someone tell me that I am wrong or how I'm a "typical cop." 02Carbon, the other LEO on this board will back me on all I've said if necessary.

The "end of the month" myth is that, a myth. NOTHING will happen to me if I write 0 summonses or 250 in any given month. Quotas are illegal in all 50 states and a supervisor can not discipline or fire an officer for not writing X amount of summonses in a Y period of time. It is the officers discretion whether or not to issue no matter what department they work in.

I personally don't waste my time with equipment violations like colored lights.
