Felt Like A Communist

So today was my first court date for the first ever moving violation. So I go in sit down Im called go up and the cop gives his end of what happen and I tell what happen. The cop simply says he observed me going through the red light and he confirmed that both lights were working. I tell the judge the light was indeed yellow and in fear of being rear ended went through the yellow light. The judge says ok I find you guilty pay at the window. I tell him are you serious he says yes you can appeal before 30 days. I dont really see how I can be found guilty by just the cops words against mine. It was as if I was already guilty and had to prove my innocence. I am not that upset that I lost the case really its $200 and only 2 points on my license but I couldnt not believe how fast the case was over (under 2 mins) he never questioned me or the cop. Anyway anyone else ever had a case similar to this?

Re: Felt Like A Communist

yay i get to goto court next month too. 29 in a school zone, i never saw the sign (it was facing backwards and not visible from where i turned). but at least cop was nice and gave me a lil break. just 10 over speeding which is alot better. but im still going to at least argue or get points off. little things like that suck. and there was nobody around no cars or kids it was a 4 lane road empty except for me. i dont even know where the school was at. the sign was really small and no lights flashing either. biggest trap ive seen.

my first ticket for speeding a while back went okay too, cop was nice and took off 10mph (so i only got 5mph over limit), and then i was able to get traffic school assigned by judge to take the points off.

now that is some shit. trap for sure. I would go to court with pics, and a link to a self made youtube video of the events re-created.

Re: Felt Like A Communist

lol yea that does sound like a trap to me, the backwards sign should be enough to justify you out of a ticket. It truly amazes me that all cops really need to do is go there tell what happened and they get a conviction. In all honesty a cop could give u a speeding ticket while your idling a red light. As long as no one is around your paying that ticket. There is not much you can say to the judge in order to fight ur way out. Unless I just got a dick judge..

Re: Felt Like A Communist

yup thats what bothers me. cop has credibility, you are nothing. but i would gladly pay a yellow light ticket instead of having a smashed car. it does sound like you had a dick judge cause sometimes theyre nice and listen, or even reduce the sentence. did you talk with anyone before the judge? like usually theres some person you tell your story and they try to bargain to lower the speed and stuff. i know im pretty much screwed, i sped past a school zone and im not gonna deny that, but it sucks the markings were very poor. otherwise i wouldve slowed down, i wasnt even going anywhere just running my car to make sure there were no leaks after changing the oil. i went back to find the sign, and i had to pull over just to read all the writing and it was pretty much 7am to 3pm all day enforced, even tho theres no kids anywhere. makes no sense. and no warning lights like all the other zones around town have.

Re: Felt Like A Communist

No only the judge listened to each of us., or so it seemed. The cop went first which seemed weird because it kinda of made me feel I had to prove to the judge I didnt go through a red light. It should have been the cop proving I in fact did. Oh well apparently as long as I stay clean for 18 months its off my record anyone can confirm this?

Re: Felt Like A Communist

ive never heard of it going off your record that fast, unless you goto driving school to erase the points. alot of times they only let you take off one point. but i wouldnt worry that much unless you plan to drive commercial vehicles. i think you have to get 8 points to lose license.

Re: Felt Like A Communist

ticket is $200 a lawyer would have to be close to if not more its not worth it. Losing your license is 12 points. (100%on that my friend lost his) I plan to take a 6 hour class if my rates go up.

Re: Felt Like A Communist

i was stopped in the street waiting to turn left to my parking lot, with signal (2x brighter than stock bulb) and brakes on, and i got plowed from the rear by a work van going 40+mph. car needed $8k in repairs, and guess what, all the other guy got was some stupid ticket like failure to maintain lane. the cop was almost not writing any ticket, even tho the other guy admitted he was reaching down and answering his phone, not watching the road at all and being totally careless. this was over a distance of almost a mile of him not even looking up once to see me stopped there. and the road was 30mph but he didnt even get speeding ticket. but i guess he was just driving a work van. if i were to rear end someone, id prolly get five different tickets.
