is it common for the spectators to be suject to criminal prosceution?

and overall these seem pretty easy as far as street racing laws go.... guess you guys in tx are too busy killing your criminals...

Sometimes it happens, but usually the police just tell everybody to go home. I think police spend more time cracking down on the people racing than on spectators. But things may be different in the bigger cities like Houston, San Antonio, Dallas/Fort Worth, etc.

Here's an example where a bunch of people were arrested for being out past curfew on a police raid on street racing activities:
