got a ticket a month after incident-what does everyone think?
About a month ago, I got in a wreck with this a-hole gut in a brand new 03 suburban, I was leaving a gas station and I hit him in the side. Well anyway he ended up calling the cops because on my insurance I have 2 different policies, one has my car on it, but my dads name and the other has my name, but not my car. So he thought that I had no insurance. Well a state trooper came and he took both of our licence and was in his car for 15 min then had us exchange info. then he told me that I was going to be recieving a ticket in the mail about 3 days from then for not yeilding the right of way and then he threw in a ticket for my window tint being too dark, he was a dck. then he drove away. this all happened on August 8, 2003. Well on sept. 5 I recieved that ticket in the mail. Not 3 days after the incident, about 27 days after the incident. I called the DPS to complain about him giving me the ticket for my tint and how he was power tripping and the DPS officer told me that he has the right to do it and he asked why I was calling now about this incident and I told him that I had just recieved the ticket and he said I should of either recieved the ticket at the accident scene or 3 days after that, not a month later. He said he is going to look into it and call me back on wednesday. Do I have a right to complain about this ticket being sent to me a month after the incident? I am thinking about going to the DPS and complaining about this and to the court house. What do you think I should do?

Yes you have every right to complain. As far as the tint, thats just a law you cant get around except pay the fine or take off the tint either one. You can always go to their internal affairs unit and file a complainant against the officer for rudeness or whatever.
hey injencivic, do you think this should be dismissed on part that probably the DPS forgot to do something, I am keeping the letter and the envelpoe that it came in for evidence, the envelope says september 4, and the ticket says August 8.
well I got a call back from the dps today and the sergant told me that the officer didnt do anything wrong by sending it out a month later, he said that the law says they have up too 2 years to get it to the person. How mest up is that. I asked him basically if I was to get pulled over tomorrow and told I was going to get a ticket in the mail in 3 days, but didnt get it untill like september 1, 2005, almost 2 years later that it would stick and he said yes. What kind of laws do we live under? that is the most messed up thing I have ever heard. I want to complain about this to someone in a law position but I dont know who, any suggestions?
