being hassled. :'(

Okay, a few of us F'ed up the other week and raced at a red light. I'm not denying that. But anyway myself and a Black 02 Si got pulled. The officer didn't sound his siren, but says he flashed his spot light at me a few times. I didn't see him until about half way through a light, and all I did was turn left like I was origianlly planning, and pulled into a parking lot, out of the intersection and path of traffic. Well he tells me to get out of the car and cuffs me. Says that was real dumb, youre going to jail. So yeah, i got put in jail, and when i was in there i found out that i was arrested for Felony Evasion. I thought it was for the racing... I was like WTF? Evasion? I pulled over and parked. I waited, how was I running?
Then when I got bailed out, I got the citation.
It was for exhibition of acceleration, speed competition and evading arrest/detention with a vehicle.

Okay, i thought exhibition of acceleration was doing a burnout. I didnt squeal a chirp. Hell, my tires were over inflated so I did a tiny bounce when i pulled out at first, definitely didnt spin.

And Evasion? I Was waiting for the officer? I dont get it... Someone please explain.

Oh yeah, and the other night I was riding home with a friend, and I noticed a truck in my mirror, looked like it had a light-bar. Anyway, as soon as i took the on-ramp to merge onto the loop, he swerved over and got behind me. My friend, said hey, theres a cop car behind you. I said yeah its a truck. Hes like no, there is a cop behind that truck... Im like why are there 2 po-po's behind me? Hes like i dunno, probably just cruising or something. Well later on I got to my exit to my apartment. As i pulled off the loop i saw them both come over behind me. Well there is a Safety Department building or something like that off the exit too, so i didnt think anything of it. Well at the stop sign, where they would turn right to go into the parking lot, they followed me. I continued down the access road and saw them coming up behind me again. So im like what the hell are they following me? Hes like I have no clue... you got a tail light out or something? Well i turned and they did too... then when i signaled to turn into my parking lot, he turned on his lights. So i pulled to the curb. He comes up and is like, we got a call that you were doing some wreckless driving... i didnt see anything so i cant do anything, but im just going to id you. Im like ooookayyyy. sure thing, sir. Then another officer walks up and it was the one that took me to the station. He says, Oh, so i see you didnt run this time? Im like, well actually sir, i didnt run last time either, and hes like well thats not what officer... whoever says now is it? And i said i guess not. THen he proceeds to give me lecture about being a criminal and drivining wrecklessly in my car. Then accuses me of speeding through a red light. A lite i was stopped at! He just id'ed me, didnt give me a ticket or anything. But he was an ass... and was accusing me of shit i didnt do. He said that someone called in saying a pack of cars was driving wrecklessly through town. I was like, wtf i was the only car on the freeway? where was the pack?

Anyway, im just tired of this. Some advice?

yer screwed bro, better move. Either that or hope they get tired of hassling you. I had a friend try and get a cop in trouble once, they were dating, she broke up with him and he started basically stalking her, had his boys doing drive by past her house looking for other guy's cars, etc. Tailing her home from work and then driving off...that sort of thing. She complained to the PD and they basically told her that until she could prove anything that he was just doing his job patrolling and she was over-reacting. Finally she mounted a webcam outside her house, mounted a video camera in her car, took photos, etc. She compiled a bunch of evidence and he got reprimanded for abuse of power. Basically a slap on the wrist.

Summary of this, you are on the bad side with that cop, you are screwed until he gets tired or you move.

the officer doesnt have to turn his siren on to pull you over. He can just use his lighting equipment to initiate a traffic stop. As far as you evading arrest, you need to look at it in the officers point of view. I cant tell you what shoulda happened because i wasnt there and i cant justify you or him in the actions that took place. The best thing to do is just co-operate with the police and hopefully they will reduce your charges.

i was trying to be co-operative... but i didnt have a chance... i was cuffed and shoved into the back of a car... didnt even get a chance to talk. also, do they not have to read you your rights any more? he didnt. he just said... YOURE GOING TO JAIL!!! :\

dude.... i got pulled driving alone on the freeway going 5 under the speed limit. :\ i cant change the way im driving...

and im working on changing the ride... im going to take my car to the honda lot this week and see if they will buy it from me *knock on wood*

if so, then im saving up for a 6th gen hatch... :\

my bud, who had a domestic, a firebird, got pulled for a burnout once (first acount of a domestic being pulled over ) anyway, he was targeted like you. so he put a camera in his car. I rode with him on several occasions and we videotaped the cop following us like once every 5 rides (stalker!!!), of course, he sped once in while, and ran reds.... we always got the same cop when we pulled over. finally we got enough evidence of harassment and got that damn cop suspended. christ, i cannot believe these damn cops once in a while. do they have ******* implants drilled into their heads??? or are they just bitter that we derive better cars than them??? i just dont understand this.

uhhhhhhhhhhhhhhh... THE COP ALWAYS HAS TO READ YOU YOUR RIGHTS IF HE IS ARRESTING YOU!!!!!!!!!!!!!!!!!!!!! OMG!!!!!!! writ of habeaus corpus. that is one of the first things that lawyers look at because it is the easiest way to get a charge dismissed. BAM!!!!!!!!!!!!!!! god, keffin, pour some coffee on your computer

if your being arrested your rights have to be read to you. Dingaling is correct on this. They dont have to read them to you if your being detained.

Miranda warnings apply ONLY to "custodial interrogations".

Police are required to give an arrestee "Miranda" warnings
where there is a custodial interrogation AND the interrogation
is likely to elicit an incriminating response. Routine
booking questions are allowed (i.e. name, address, date of birth, soc sec #, etc).

You were arrested (that's custody). If you were never interrogated, a reading of Miranda warnings was NOT required.

Many people are arrested & never interrogated. However, police officers routinely do read the Miranda rights, just to cover their ass in the future... JUST IN CASE!


***Miranda v. Arizona, 384 U.S. 436 (1966)

Before a law enforcement officer may question you regarding the possible commission of a crime, he or she must read you your Miranda Rights. He or She must also make sure that you understand them.***

lol... thanks guys... i was never interogated... he just asked me if i knew the other guy... and i told him no... cause i didnt know him...
and he thought i was lieing, cause hes like too bad... would have helped your case... im like i really dont know him. other than that, no questions were asked.

and i do have a lawyer... she seems confident that the felony isnt going to hold up...

what im really worried about is the contest of speed... i wont be able to afford insurance...

WOW brother...just stop. You are definitely confusing the Writ of Habeus Corpus with something else. WHC is the original clause of the Constitution guaranteeing people the right to stand accused before a court. Without it, governments would be able to hold prisoners indefinitely without trial. It also pertains to the ability of federal courts to oversee the judgement of lower courts. The Miranda judgment, as previously stated, stemmed from the Supreme Court Case of the same name in 1966. This judgment stems more, however, from the Fifth Amendment, and Due Process, which is probably what you are confusing the WHC with. As you may or may not know, The Fifth Amendment is simply a clause saying that no one is required to make incriminating statements under oath against themselves, and Due Process ties in by saying no one need be incriminated without the due process of law (the right to a trial by jury, legal representation, etc) The Miranda Rights are basically a summary of these constitutional rights...right to remain silent (Fifth, Due Process), right to an attorney, one will be provided for you if you cannot provide your own (Due Process), etc. You should probably brush up on your Constitutional Law before you go around calling people morons.

keffin-You are absolutely right, you did not reduce yourself to name calling at all! I was so more referring to DINGALING on that one! It was just the two of you were going at it, so, it was addressed to both of you since I do not know you. And, with DINGALING provoking you like that, you could easily reduce yourself to insults/name calling. But, you never did, this just shows me your caliber, I thank you for that and so appreciate that. I called it like I saw it and that is all I can do, I felt you both were riding the high horse. But, you tell me differently, then, I will go with you that you were not for you have proven your caliber to me.
