Need advice about ticket.

Hey everyone,

First time posting in this section as I need advice on what I should do about a ticket I just got an hour ago.

I was at home studying when my friend called and got me to come out to go with him and another buddy to grab a drink (Bubble Tea). I decided not to drive my car because he offered to drive. He has a 92-95 EG Coupe so I said alright I'll ride in the backseat. I climb in put my seat belt on which was only a waist belt for some reason but I didnt think anything of it since my Dad's cadillac was like that as well for the rear seats. Anyways, we're on our way and my buddy is doing 70km/h in a 60 zone. We get pulled over by an undercover.

We all had to give the two cops ID but I forgot my wallet at home so he takes my information down and goes back to his car. So me, just sitting there waiting and waiting, he comes back and asks me again for my information because he spelt my name wrong and it wouldnt come up in the system. Comes again because he still cant get it right and asks whether I'm wanted to something, if I've been in trouble with the law before, etc. Now me being a little pissed now still waiting to leave.

He comes back and gives me a ticket for not wearing a seat belt. I'm like, "uhhh whats this for?" - Cop, "For not wearing a seatbelt?" - Me, "Seatbelt?? What do you mean seatbelt?" - Cop "You know a seatbelt, a belt you are suppose to wear etc, etc." - Me, "But sir, I am wearing a seatbelt."

I Point down at my waist showing him the seatbelt and he's like oh, I didnt see that before... Goes to his partner hey he is wearing a seatbelt. And I was like yeah I was. They didnt tell me that I was even getting a charge or fine for anything. I told them I wouldve showed them if they said anything but they didnt. Then they are like oh well we cant do anything about it now, blah blah blah. Take it to court and you might win or might not etc.

I'm like well isnt ther anything you can do like write you didnt see it or something. They are like nono we cant...

Man, what am I to do?? I think I'm screwed... I shouldve just drove my own god damn car.

do exactly what the cop told you and plead "NOT GUILTY" and set a court date. when you go to court tell the judge you were wearing a seatbelt and the cop didin't notice it because it was a waist length belt. if you have a clean record, something like this will get tossed for sure and you'll get off without paying a dime. the only downside is that you'll probably have to take some time off work to go to court.

Why are you scared...seems to me like the cop didn't want to take actions for his mistake. If i were you i would call up or go to the police station and demand to talk to his boss or something he admitted his mistake and wont do shit about it. If you don't have got the ball to do that go to court and just tell them what happened thats if they believe you..

it will get thrown away my friend got a ticket like this when i was driving my car and he was in the backseat, he wasnt even wearing a belt and it still got thrown out. Schedule a first attendance and it will get thrown out
