If its GSM service I think that they will change the SIM chip and give you a new number, with a monthly plan of course. But you should also try to search for the real owner...

If it is a tdma device then more than likely you will NOT be able to get it activated because it will be on a deny list. A deny list is whey they add the fons esn or imei to a program that does not allow it to be used on that carriers service. If it is a gsm device and you want to use it with any carrier it needs to be UNLOCKED if not you can only use it with the provider thats labeled on the fon.

If your cellphone provider doesn't use those little simcards, then likely the phones are acivated using a unique ESN number. If someone loses his phone, he would call in to his service provider and the ESN for that phone would be put on a list, so that if anyone called either to report that phone found or try to activate it, the ESN (which the cellphone company asks for when activating) would come up flagged. I know this because I lost my new cellphone less than 10 days after I bought it, and no one reported it back, I had to buy a new one for 400 bones. Boo-urns.
